Hi, anyone got any news (assuming you have managed to negotiate this painfull log in process) about when the occupacancy licence will be issued and what the delays are? We keep being told next month (since Nov 2006) - 24/01/2008

Hi there, we are waiting just like everyone else. I visited the site a couple of weeks ago - met the security man/gardener - all looked Ok - even had a coat of paint. But still no licence. heard rumours of delay due to building on "protected" land and over Roman ruins - the truth would help. I have asked my lawyer to look into taking legal action for return of the deposit.

Hi, you're probably past wanting to talk about it (like me) but it would be great if we can keep in touch via this site. I'll try and do the same although "Roman Ruins" really cake the cake! What ever next?  02/07/08

Hi,

Was at Royal DuQuesa Hills a week ago - we have family who live in Marbella.

The development looks exactly like the last time I was there a few months ago - only difference was the swimming pool that had been cleaned and the trees etc trimmed.

Royal Duja Group( or any variation !!!!) have now closed down their operations in Peurto Banus and are apparantly working from someones house.

I am trying to get a contact number and also find out who to actually deal with regarding the development - should It be the Builder or Royal*****.

Hi, is this development the blocks right on top of hill up past Monte Duquesa with the wire mesh fence across the road?

Hi, good to here from you. 

They are right on top of the hill but they didn't have a fence accross the road when i was there last. the whole thing is taking forever.

There are only around 40 units, 4 stories high.

i can email you a photo if you wish but can't seem to get one into this message.

Any info would be helpful.

I have looked at the posted photo and yes thats the place, a friend who has bought one of the top apartments has been waiting ages to complete. I have a townhouse in Manilva and an apartment in Duquesa Village near by. I just came back from Spain this week. 

When I went past 2 weeks ago I saw a workman drive out and I stopped to ask him when they would be completed. He told me that within 8 weeks the place should be inspected by the Manilva townhall and if all was well the occupation license should be issued. He did not speak English but my limited Spanish seemed okay with him.

He had the keys to the box on the right at the bottom of the road and he opened to do something. It looked like a power/water cabinet for the site.

Hope this helps in someway, I am out again in 4 weeks I will see if I can find out anything else.

My solicitor tells me that the builder has a meeting with the Manilva Town Hall on thursday 25th September, when he hopes (so do I) to get the licences.

Having said that I beleive that the developer should pay compensation for the 3/4 years that the deposit monies have sat on deposit - to his advantage. There is another matter of course is the value of the property now - I hear that it has fell by 15% , can I get a 70% morgage ? I may only be offered on the present value  - so again I shall be talking to the developer.

On a recent visin (late August) I noticed quite a bit of exterior deterioration to the concrete facias and a couple of the outside water heater tanks were rusty - so do a very detailed inspection before signing anything !!!!!!

If everyone stood together then perhaps quite a bit can be achieved.

Let me know any thoughts.

Don't know what you paid, but have an idea what my pal paid for one of the penthouse apartments. Although he (one) may be able to get his deposit back with interest and a fight and possibly a long wait.

I do know that certain properties have not dropped in value (my own townhouse because of size and location), they have just stayed stable. If you bought at a low price it may be prudent to keep it.

Also if you decide to keep, list all the faults/problems and ask for a discount. I did on an apartment and got 7% off the price which paid for the furniture.

We got an email from our solicitor Maribel on 29th September saying

"the developer has just informed us that they have everything ready to sign the title deeds of your property, we have anyway applied for a copy of licence to check everything is correct"

Needless to say we replied immediately and have heard nothing since!

The delopers are called Rodelsa and this is a copy of the email we received 7th March 2008 from Olga at Royal Duja. 

Dear Clients,
 
Attached is the latest update on Duquesa Hills, received from the developer, Rodelsa, yesterday 6 March 2008.
Basically, to translate, they confirm that they are still in the procedure of finalizing title deeds and completions for clients.
They also confirm that once they obtain the First Occupation Licence, they will then proceed to obtain the Building Insurance which guarantees that the building has been built correctly and thereafter obtain the End of Works Notarial Act.
Once it has been registered in the Property Registry, the corresponding Title deeds will be prepared in favour of the purchasers.
They want us to pass on their apologies for the delay which has been out of their companies control and want us to inform clients of this apology.
 
I will keep you informed when I have more news.

Hello Nigel. Yes we’d be very keep on getting our deposit back but I am concerned with throwing even more good money after bad. It would be great if we could get an honest appraisal of what our chances are cheaply before we get our wallets out. A “no win no fee” arrangement might be the way forward but I’m not sure if that is an option on this type of case let alone in Spain. Please let me know your thoughts. Regards Jared.

I received legal advice that suggested a good case. However it is not a cheap exercise as the developer will fight it all the way. I think we need more "owners" to club in to make it feasible. Is there anyone else interested in joining in? I will circulate the advise if we can get a few people interested.
