Hi Everyone

After the Condado cancelation I moved to TDLT on advice of a Polaris agent. This was almost two years ago now and building has just about started, with an estimated time of hand over for phase 1 of march - april 2009.

How do other similarily placed investors feel about these constant delays?

Has anyone managed to cancell their contract with PW, if so how much of your 40% did you get back?

Has anyone managed to sell a contract to another investor?

We are in the same boat as you.  We have just written to our solicitors asking the question, can we pull out with all our money, I will let you know the response, when I get it.

Just  got back from spain .We were fed up after moving from condado on to terraza phase2 and still no sign of a property so went to polaris hq to find out what is happening.Spoke to custermer services and was told phase2 is now phase8 with no planned start date. Phase1 is well under way so we were given the option to move on to phase1 with a discount which we have done.The completion for these we where told is dec08/jan09.

Someone from customer services at Polaris World telephoned me yesterday.  Yes there are real people there!  He explained that Phase V where I am purchasing has now become Phase 2 and is well under construction.  When asked when it would be ready he said Summer 2009.  I explained that this is a year after the original date and we are due to relocate at the end of 2008. 

He also said that the golf course was being  landscaped now and would be ready at about the same time.

Considering we visited the site last June and construction had started, this revised date puts Polaris World outside of their 18 month delivery time.

Is anyone else on the old Phase V and considering asking for a refund?

Polaris seem to have cleverly worded their contract, I t does state 18 Months completion, but that is from the day they start on your actual apartment. So you need in writing from them the start date of your apartment.

I also am on Phase V and have had numerous discussions with them but they dont care a toss.

I have just posted a reply regarding a refund from Poalris World.

We were contacted by them to offer us a refund as they were no longer building our apartment.

This was in Nov 2007 - nobody from Polaris bothered to contact us after so we went over the their HQ in Spain, finally got the signed agreement but still no date for our money, so don't hold you breath for a refund.

My partner and I have just returned from a trip to Spain.  Whilst there we visited Polaris customer service to try and find out what was happening with our apartment.  Needless to say it was a futile exercise. 

We are on the old Phase V (now phase 2) and Polaris confirmed that construction began June 2007, but that our property will not be ready until the end of 2009.  When we pointed out that this was well over the 18th months contract they became very defensive and said we would have to speak to their legal department.  We arranged from them to ring us on Monday 24th March to date no call. 

They did however offer us an alternative property at an extra 100,000 euros!!!  Very generous under the circumstances. 

We are intending to take legal advice to see where we stand regarding a refund.

Hi,

I have just contacted a solicitor today and I am in the process of sending over the documentation.

To be honest with you I wouldn't waste my time phoning them, I've tried since they first offered us a refund in November - you will just be dragging things out for yourself.

Hi All

Yes We are Tired & Fed up with Polaris World! We put the deposit down 40% as per agreement on Terrazas.

Like many others we were contacted in November 07 as there was a problem with our plot!

The uk Manager came to see us and offered us some fantastic plots at discount or a refund, having listening to her sales pitch we decided to opt for a refund & was told that we would recieve the full amount shortly.

After many emails, phone calls etc.. we hve still not recieved our refund. we have instructed a solicitor the same one as we used to buy, we sent him all the documents 3 months ago and he still hasnt got back to us!

We are now getting really frustated & worried can anybody help with solicitors or advice .

you sound exactly the same as us, in the end we gave up contacting them and insIf tructed a solicitor, it took hin just under 2 weeks to get our money back, it cost about £425 but with the exchange rate as it is we more than made up for it.

I have put his details on this website, just email him and tell him you've been in touch with Alyson Hembury and he will take it from there for you.

Please don't waste anymore time waiting for Polaris to get in touch.

Hi All

I wish Polaris would cancel our property.  After several emails to them, they finally telephoned us last week.  They have now confirmed that our property has in fact not been started, do not know when construction will start, but confirm that it will not be ready until the earliest December 2009.  We have been through the contract again and our solicitor has confirmed that we cannot cancel without losing our money and Polaris are not in breach of the contract.

We are in a no win situation they have got our money and we have just got to wait.  I would advise anyone thinking of buying off plan to think again.

If you dont want to wait for your property to be built they will switch you if there is one on another phase that is being built now. Speak to them and see what is available.

When our apartment was cancelled we were offered another property.  However, it didn't match up to our first property.  The first one was front-line to the golf course but the replacement offered wasn't and it was more expensive, even though a discount was included.  Still didn't receive the refund that was promised to arrive on Tuesday.  Told it will be next week.  It's a long tiring process.

Hi Snil,

Don't be daunted by some of his english, he really is good. He threatened to go to the bank with our bankers guarantee which apparently is not good for Polaris.
