As you all know the developer is charging or attempting to charge an exorbitant amount of interest to all those off plann buyers who are not completing  their properties as the first occupation licence is not in place. All those interest are illegal after the spanish law and they are considered abussive within the Consumers Law. Furthermore the delay is being caused itself by the developer for not having the first occupation in place, therefore you can not be fined for a delay caused by the other party, this is Law and the other version is absolutely illegal. At the same time the developer is trying to charge all the outstanding community fees outstanding since the moment they consider the complex was finished, this is the same situation as before, you can not be a debtor with the community as you are not a member of the community of owners till you complete the property at the notary.

Wow, wish I would of known that a couple of months ago. I compleated in May of this year the apartment had apparently been ready for over a year and they charged me 9000 in interest and 3500 in community fees which my lawyer told me I had to pay or they would cancel the contract. Do you know if I can do anything about it now? I was told the licence had been granted and I stupidly belived  my lawyer.
