How come there is so much  mistrust  in Taray      We all looked at what was on offer   and we ourselves   decided to buy on San Cayetano  None of us were forced into buying  in a foreign country  . We are living here waiting for our new home   hopefully before christmas this year  .  It is due for completion at the end of december  But we are hopeful  .We have been watching the whole complex grow . It looks fabulous .  They have started to clear away some of the  clutter from the pool area ,but it is pretty obvious to all that to build the pool before work on the homes is complete then we would be swimming in a mud bath !!!!!  They have cleared away the mess from behind the villa's .Our solicitors have never mentioned anything about the pool being municipal   but we will check on this. I would personally not take too much notice of the scare mongers . Do these people really want to buy or even live in spain. Have they thought things out completely before laying down their deposits and signing their names.I think possibly notWe are all moving to a new country where things are obviously going to be different  to the UK and in my opinion could not possibly be worse  than over there   Sorry if i appear to be on my soap box  but  we are all entitled to our opinions.....................        Sheila

Hi Sheila

Some customers have had properties ready since December 2006 but have been unable to complete on them because of the issue with the LFO.

Hopefully you will not have this problem when it comes to December this year.

hi sheila,

its not that we and others don't like the development. we have wasted 20 months so far. at some point we must say enough is enough. we cannot complete unless we get this licence. remember we need need a mortgage for our house. we had everything arranged until we found out there was no LFO. our mortgage broker was smiley. he couldn't give us our mortgage without it. this is a big issue at the moment for many many people.

Taray is a reputable builder and I think we all recognised a good standard of finish in the show homes.  Everyone will have had their own reasons for buying in Spain and maybe some people had not done as much research as others.  One of the frustrations of buying off-plan is that things can and do change and the majority of us are still in the UK and unaware of what is going on.

Check with your solicitor and Taray as quickly as you can.

Our solicitor said (August 2007):

"I have spoken with Taray about your swimming pool, is municipal, this means that you will not pay to maintenance you only going to pay when you use this facility.

I have read other time your contract in order to check if your Anexo III, is a general or particular description regarding swimming pool, there is a general description of Elementos Comunes; this description come from law."

Our agent said (November 2006):

"I can confirm that Taray are providing municipal leisure facilities and swimming pools.  As a community you will not have to pay for a community swimming pool and this will greatly reduce your annual community fees.  Taray are intending Hacienda San Cayetano to be their premier development with excellent facilities for its owners.  Taray have confirmed that they will be offering owners a reduced rate on the swimming pool and may offer an annual reduced charge."

I am in no doubt that it was always the intention of Taray to put the pool etc in place as the very last elements for obvious reasons. 

Alerting other owners to the fact that the pool is to be municipal is not 'scaremongering'.  It is clear that very many owners were not made aware of this fact when they signed up and the advertising and marketing materials do not make this clear, on the contrary, they lead people to believe that the development benefits from a communal pool and sports facilities, as you still seem to believe. 

As you are already resident in Spain, you are in a better position than many of us to find out the clear, definitive answers.  Let us know when you do!

I am happy with my decision to buy at san cayetano and was told that the pool will be municipal when i put down 3000euros which was july 07.

2 weeks ago im told from taray that the sports area will be the same municipal why did i not get told this at the start???

look at the bridge at balsicas how gutted would you be if you had bought there?  agin taray not being honest.

Its not scare mongering at least people who never knew about pool know now.

Ken am i right in saying that you cant get a mortgage untill lfo is in place?

does that mean all people completed have had to pay cash?

Hi

Whilst I don't like posting under this heading as I am not a Disgruntled customer!! I would just like to put a couple of things accross, we have purchased a penthouse apartment in block 1 due for completion March 07, however like a lot of people we did not want to complete until the LFO was in place, we took lots of advice and the majority feeling was to complete without it as Taray had a good reputation and that the buildidng society would not lend money on it if they thought it was high risk, so the final decision was ours and we completed in July 07, and our mortgage broker too was Smiley!!!! so there seems a lot of conflicting information, we are happy with our decision whether it be right or wrong we made it based on the information at that time and this is what life is about.

By the way while we were our there in August we were told that the work on the pool would not start yet and I can understand why, after spending hours clearing dust from the patio areas of our apartment within a day or so it was covered again due to the building work and a couple of realy windy days, so it would be a wasteof time starting to do this before all the building is completed, after all there are miles of coastline to be discovered and we are looking forward to doing this!

hi Iain,

i believe some local lenders may "overlook" the absense of this licence, but by no means all of them. Generally, this licence is a requirement for most banks before they lend on a mortgage.

we may have to pay to use the pool but im told we will have a lifegaured which im more then happy to pay for (if there is going to be one).
