Hi everyone

I would just like you all to know that I have just received my full deposit back after sucessfully issuing court proceedings against the bank who issued the bank guarantee on behalf of Taray on a phase 1 property. Maria de Castro's lawfirm Costaluz Lawyers acted on my behalf after they had a copy of my contract and advised that the specified deadline in the contract had passed without the licence of first occupation being in place. A year after telling Taray that I would be cancelling the contract due to this breach, the case was won in court and the full refund returned, plus some legal fees and legal interest.

Anyone who thinks they may be in the same position should contact a reputable solicitor such as Maria (who can be found on the general forums of Eye On Spain) who can advise them if they have a similar case for full refund.

Hi Julie & Steve

Apart from ourselves, we know of another couple who have received a letter from Taray saying the LFO for Manzana 1 has been granted and that completion must be made within 30 days of the LFO being granted.
They like us are trying to get their deposit back due to lack of LFO.
I wouldn't be surprised if Taray are only sending these letters out as an attempt to pressurise buyers (who are looking to cancel their contracts) to go ahead and complete!!

Hi Dave
We instructed  our new lawyer Maria de Castro in November, the court proceedings we issued a few weeks ago and we have been told it could take between 6 months and 2 years.

Our solicitor believes the lack of LFO at the deadline for works to be completed on the contract (120 days after planning approved to commence building work and then a further 24 months to complete work) is grounds for cancellation in itself and also Taray had never supplied us with the bank guarantee (which again is grounds for cancellation)

Having said that Taray and the Bank are not accepting this - hence legal proceedings
