Hi we have bought an apartment in Marina del castillo overlooking the sea and the swimming pool which is now not going to be built. We are not happy is there anyone else who feels the same?

Hi Lizzy,

We were there in June and spoke to the site manager who informed us that the pool was not going to be built in the exact location as on the plans, it was going to be moved to one side as its position was too near to the promenade which is going to be extended in front of Marina Del Castillo.  We have also bought beach front and will be dissapointed if the pool does not go ahead. 

I understand that the development has a bank guarantee, don't know what kind of input they have in this or if the builder is in breach of contract if the pool does not go ahead?

When did you agree to purchase, was it fairly recent?

When we bought there the plans show a pool at the front and the side, I have a copy of the plans if you need them.

Hi I'm new to this message game so I hope I'm doing it right!

We bought our apartment in April 06 so quite early. We also have plans with the swimming pool clearly marked.Our solicitor has registered our dissatisfaction with the developers but up to now we have heard nothing. We are contemplating what to do next.

Hi kelvin,

No luck as yet, in talks with a couple of people so shall wait and see. To be honest its breaking our hearts selling it, if we could keep it we would.

Who ever does buy it will never look back.

Si,

Nice to hear that at least someone is interested after all the doom and gloom about property prices and sales on this forum.  I believe that if the property is in the right location then it will always sell.  Beach front, near to an attractive port and several Golf courses (I don't play) will, in my opinion, always be attractive.

It is a stretch for us to buy ours, but I'm hoping that in about 10 years time when property prices have increased someone will say to us "How much did you pay?  Why didn't you buy 2?"

Did your solicitor make any comments about the pool not going ahead when you registered your dissatisfaction?

After reading through the contract he said that once the biulding was conpleted he thought that we would get our money back, plus interest, if the developers hadn't put in the pool. However our confidence in him is not 100 percent and we have sent several e-mails to him regarding this issue.

Hmmm, interesting.  I think I will wait until nearer the completion date before approaching our solicitor.  I will ask the question on the general forums.

Just forund out some news, the pool is apparently "on hold" due to Manilva townhall being undecided as to how much room they need for the promenade. They may still build it but wont know until nearer the completion date.

Hi Everyone,

Just found this forum. 

 We are also purchasing an apartment ground floor, front line beach, close to the swimming pool that is now apparently NOT going to be built.  We visited the site in July 07 and were then told that the pool did not have the appropriate licence and would not be built.

We spoke to our solicitor who in turn spoke to the developers who say at this stage they can not say either way.

We purchased the poperty on the understanding that there would be two swimming pools. It clearly shows them on the plan attached to the contract and states smimming pools in the discription. The front line beach apartments near to the pool  were more expensive because of the location.

Our solicitor is not much help seems to be more helpful to the developers.  Does anyone know if we can pull out of the contract and receive a refund or do we not have a leg to stand on! The spanish Law seems a minefield.

Any help would be appreciated.

Hi everyone

We have purchased a two bedroomed ground floor front line appartmentand looking forward to sipping the sangria.  Has anyone any news with regards to the second pool.  I heard that this was going to go ahead!

We have also purchased a 2 bed frontline apart. near the planned swimming pool. (We may be neighbours!)   Who told you that the pool is now being built?  I have been trying to find out but cannot get a reliable answer either way.

Re. second swimming pool.  I was out to the development at the end of September and asked about the second pool.  The manager confirmed that they weren't going to build the second pool as the area they had planned to put it in is too small and it would look silly if they tried to squeeze it in.  Obviously things can change but they seemed as if they had made their mind up about it and given that they have made no attempt to do anything on the grounds at the front then I would be very surprised if a pool was built.

Thanks Stephie for the info on swimming pool. We are not happy as the pool was one of the reasons we purchased our apartment.

So if there is anyone who wants a 3 bed apartment which overlooks both the ruins and sea please contact me.I am serious.

Lizzy, is there nothing you can do through your Solicitor ?  the general opinion seems to be that if the development is not to the specification declared on the plans etc. then money can be reclaimed.

That's my intepretation of what has been said if the pool does not go ahead.  Can you do anything before the developer has said officially that the pool will not be built?

Hi

We were out at the development a week or two ago.  They are currently landscaping round the development and there is no sign of the pool at the front of the development.  We got up into our actual apartment and walked through the building to the show flat.  It is all loking great and is well on, with just all the finishings being done now.  We didn't ask again about the beachfront pool because there was no sign at all of anything other than tidying up of the front of the building.  The response from Ros y Falcon in September was that they weren't going to do the pool at the front.  Sorry!
