One of the agenda items at our AGM is 'Debtors'. We will be expected to decide as a community how we should handle this issue. I have started this thread to see if anybody has any ideas or views how we can handle this remembering that what we really desire is to have no debtors.

One way to reduce the list is to let me pay my fees!!!. I have been trying since February to pay fees, On the strong advice of my lawyer which has been proved correct by comments on this site not to let the AEA have my bank details.  I have emailed AEA, several times,called into their office on the two occassions when we were over in Spain( Feb & Jun) requesting their bank details so | can deposit cash into their bank account, to date no response to emails, when we spoke to them we were told, we will let you know.  Does anybody have anyone have any suggestions, please let me know so I can pay my dues.

It could be some other people on the list are in the same predicament as me

I had this problem in my community when I took over nearly 5 years ago as President.

We solved it by increasing the community fees immediately by 20% and we gave a 20% discount to those that paid within 30 days of the due date. We pay half the fees July and January each year. I now have no debt problems except for one case (see below) in 5 years.

We also looked at changing the community rules to stop debtors using their properties for rentals on the basis why should they be making money at other peoples expense, and making money by keeping the money due to the community in their bank.

Holding back money from the community because there is a problem or because some people don't like the way Administrators behave is not an excuse, and debtors have no votes, so you can double the budget and give 50% discount to those that pay on time. !!!

We also can put the debtors list on the community notice board and list the house numbers.

I suggest these ideas are put forward at the AGM in August.

I did have one debtor and I wrote to him to remind him of the Horizontal Law on debtors........IE I would go to court (representing the community) via the town hall to secrestrate (spelling?) his property, it would then be sold and all debts paid off e.g. community, mortgage etc. the remainder would go into community funds and he would get nothing. Also the community would claim my flights and costs to attend court as was not resident in Spain. He paid within 7 days.

Derek,

I find it hard to believe that your lawyer advised you not to give your bank details to AEA. Did you or your lawyer give the details to Endesa for electricity and AguaSur for water? If you don’t pay these on time you are cut off with no reminder and have to pay a reconnection fee. Most lawyers set the contracts and direct debits up for you.
 
I would recommend that AEA are given your details but give them a letter with details and add a clause that under no circumstances should they take more than XXX euros per quarter and state that they must not give the details out to any other body and make them sign your copy of the letter.
 
Also go to your bank and give them a list of allowable direct debits in the form of a letter:-
 
AEA, Endesa, Aguasur, Telefonica, Insurance etc. again get the bank to sign your copy. Use on line banking to check twice a month that only authorised payments go out.
I think there is a 15 day window to claw back payments perhaps somebody else knows more about this? You could also give the bank a copy of your letter to AEA.
 
I had a neighbour that did not notice that she was paying community fees to two other communities. She went to bank after 9 months of not noticing and they recovered the money.
I have used direct debits for 5 years with BBVA and use Banco De Andalucia for DV so far I have had no problems.
Try to contact Rosa or Melissa in AEA Marbella office, they have been very helpful when I spoke to them.

Thanks for the information. I agree this should be presented at the meeting. I have looked through the documentation I received from my lawyer at completion and there is a section on Horizontal Law and in that there are similar rules of the community outlined in there.

Thanks for the information, I emailed Melisa at AEA, who was very quick in her response, she emailed me the AEA bank details and I transferred the mones owed today (26/7/07) thus one less debtor to worry about

Hi All,

We are down as Debtors on the list sent out but we had already paid in full!  Judging by the number of posts from others on this site it would seem that the debtors list is not that accurate anymore and maybe we should ask for a quarterly debtors list to be sent out to the members of the community.   I am an accountant and I know it's not that hard to e-mail an aged debtors list out to everyone in the community 1 month after the fees are due.  This way, we as a community can track the members who are not paying on time and then deal with it accordingly.

What does everyone else think?

Hi Daniela,

I agree that the list is probably inaccurate and that AEA should be able to provide monthly listings.  In fact I see no reason why they should not produce full monthly  cash flow statements or accounts.

It used to be possible to view one's individual financial account on the AEA website, but this now seems to have disappeared.
