We have a long term tenant  [11 month contract] in our apartment in Duquesa, 3 months no problem with rent and paying bills, however last 3 months not paid anything and ignoring  our polite eviction notice letters and emails and our property manager requests to leave.

What can I do to get them out legally [ the contract is sound and allows eviction if not upto date with rent and utility bills]

Am I a loud to arrange termination of the utilities and change the locks? I heard that this a crimminal offence against me the landlord.

If I have to employ a solictior what would the costs be and how long does it take to get a court order?

Any advice is welcome as I understand this is becoming an increasing problem

 Help is required, having read an article in EoS the piece that interested was and I quote

To provide consistency, there are very strict guidelines that the valuers have to follow, which can have the unfortunate effect of ignoring the individuality of each property. In addition, the guidelines are open to use by the Bank of Spain as part of the Government’s economic policy, by dictating that values reported for banks must be reduced or increased (rarely that!) according to certain formulas with the aim of reducing the rise in property values.

Does anybody know how I can get hold of the formula as I want to challenge the bank valuation in 2006, the RICS valuer based his valuation on the promoters over  inflated price, my contension with the bank is that this was done to get the mortgage ratio right within the bank requiremnts and no due dilligence to me or the bank

We are travelling down to our new apartment in Duquesa from Malaga airport. Using the link on the home page it trawled through and gave us a list of cars plus rates but no name. Question is has anybody hired a car using this facility, if so were firm and car reliable?

I saw this article in a Spanish paper a couple of days ago

Capital Gains Tax for non-residents reduced from 35% to 18%

Legislation to reduce Capital Gains Tax for non-residents from 35% to 18% (and increase it for residents from 15% to 18%) was approved by the Spanish Senate in October. The new regulations also reduce the withholding provision that non-residents pay when selling property in Spain from 5% to 3%. The new regulations come into force at the beginning of January 2007. Non-resident vendors should try to delay completion until January 2007 to benefit from these lower taxes.

 can anybody advise me on the following:

  1. How will this affect us in the future when we want to sell our property in 5 to 7 years time if we complete before January 2007?
  2. Does this mean if we complete before Jan 2007 we will be subject to 35% capital Gains Tax when we eventually sell
