To anyone who is interested had some good news today from our solicitor saying the judge had found in our favour with a full refund plus interest and legal fees ,but allsotold us the banks will probably appeall so keeping our fingers crossed ?

Well done and congratulations on your good news.

We are in very similar position to you.

We won our case back in October 2016. Bank have lodged their appeal as expected. However our legal team served the bank with a Provisional Enforcement requiring the bank to pay as per the original court sentence. 

yesterday (Friday 10th February) we had email from our legal team informing us the bank have paid into the court account and our legal team  have served the court with a " Mandamiento de Pago " which as I understand, is an order to the court requesting the money transfer to us ( sooner rather than later hopefully  ) .

The banks know they are never going to win , especially in light of the Supreme court rulings last year, however the banks continue to drag on denying their responsibility under law 57/68. 

You will certainly get your money returned its more a question of when.

Thanks Broph for the words of encouragment its been a long journey and we are not counting our chickens yet .A couple of weeks ago the bank BBVA were saying they had no record of our original bank transfer ,so as I say what comes next. I still cant believe these so called big banks carry on the way they do ,allmost like a bunch of crooks ?

Just heard from solicitors that court has dismissed the banks appeal and they are liable for our interest and legal costs.  Hopefully, the payout shouldn't be too far away as the deposit money is already in the courts account.

Hi to you all.just received our deposit and some interest this morning from GM Legal.Guadalup and her team were fantastic,it has only taken just under 2years.off to the bank to draw it all out now.

Tommy2 do you know at what rate interest was paid or from when ? keep hearing different amounts and varying times ? Have you managed to spend it yet ,hope you thoroughly enjoy it .

GM Legal Experts won my appeal in the Supreme Court in September 2016. It has been a long battle but thankfully the court decided in my favour that I should receive a refund of all monies paid plus interest. Fees were excluded for some reason. I had hoped to receive payment before Christmas but apparently the court dealing with the enforcement is a acting very slowly. Let's hope it won't be too long now before I receive repayment.

Hi all,

Just heard gm legal chasing money from the court but person who deals with the files is not at work and don't know when they'll return,!   Couldn't make it up, lol !!

If  gm don't receive it this week, they are complaining to the Judges Association.

What next!

Joyjo as I said I am not counting my chickens because you could not make it up what they will get up to next ? all though we had all the relevant receipts from the banks about our bank transfers !! guess what the banks when it went to court could find no record of it .You would think you were dealing with a con artist not so called international banks ?

In my case the court requested the account information from the banks at the preliminary hearing.  8 months later my final hearing was cancelled because the information was not provided (which has since taken them a couple of days to provide). 

Guess what, nobody checked and nobody knew, resulting in the banks delaying my case from February to June this year.  

It's  too easy for them to make monkeys out of us I'm afraid, and if something as basic as this can delay cases, what can you do.  I'm currently checking all my court documents sent to me for any wrong names, words, dates and information, and I'm finding things as well, which is worrying eh!!!

No I'm afraid we were sitting ducks.   The trouble is we all think it was our fault for being gullible but it was Spain that was like the Wild West lawless show.  

It will happen again too.  Just not to us, we have been damaged!!!

We would like to inform you that Court is going to send us the bank draft (mandamiento de pago) of the deposit plus the legal interest.

When we receive it we will inform you, and we will request you your bank details.

It can take several days.

Hi, we received the above email today from our legal team. Whilst we have not yet had final figure for legal interest and we were not awarded legal costs we await final amount to be paid to us. 

At least our long road to recovery of our money is very close to a successful conclusion.

Hoping this will give encouragement and help lift the spirits of other people in the same situation.
