Did anybody else got an email from ML regarding owing community fees for years 2009/2010?
Since the charges started we always paid our fees, now they say in the files of the first resort managment there is a outstanding balance of not paid fees from 2009/2010. How can that be?

Resort Fees started from August 2008 Community Fees Started in May 2009 ? the period between all bills were paid Gardeners water etc by the builders all this money was paid back to the builder but left a gap of funds that owners have to pay. but from date you signed your deeds you are liable? many owners paid the back fees some time ago, but there is a substancial amount still to beclaimed and owners responsible have top pay? The Majority of owners were tracked down in 2009 and paid the backdated fees for 2008 this could be the fees you refer to?

A lot of owners had no idea they had to pay from Aug 2008, I for one was told we pay from the first community Meeting this was actually wrong and i was liable from date of signing my deeds.

You refer to 2009/2010 and the old administrator who collected the fees for the early part.

It has taken a lot of work for the current administrator to sort the old files and find the owners who had not paid.

You will need to produce evidence to Mileniun Bank statements etc to prove you have paid otherwise you may be liable, if you are paid up to date and have no outstanding fees then you should be able to prove it, and if correct ask for an appology.

It's more than likely that the previous administrators have mucked things up. This happened to us even though we had given them our spanish bank details they quite frankly "forgot" to take the amount from our account! Unfortunately, even though this wasn't our fault we had to pay extra to Mileniun on top of the actual payment. It wasn't a great deal, but we thought it rather unfair, and told them so. Didn't make any difference, we still had to pay the late payment charge! I wouldn't mind but every other payment had gone through except this one! However, Mileniun informed us well over a year, possibly 2 years ago, so it's definitely worth checking back through your bank account.

 When ML took over from RPM all the community accounts were handed over on paper rather than in a digital format, this made things very difficult, RPM were also complete amateurs and did not keep correct accounts.  So,  ML received accounts that simply stated that Jardin X were in debt in 2009 for €X but in most cases it didn't specify the actual owners that were in debt.

Over the past two years we were chasing RPM, who said ask the bank, and the banks who said ask RPM.  Slowly information has been received from the banks to identify the owners that were in debt for 2009, so perhaps you fall in that category?

For info here are the details of the 2009 debt from June 2012 ( six months out of date I know, but ML stopped providing this infromation to the presidents last July after then held their illegal meeting to elect a new level 1 president )

Hi tashajohn,

If you are signed up to the community website, then this should show any outstanding balances on your property.

- go to www.condadodealhama.eu

- go to (english version) owner access (top right)

- sign in to the intranet (or sign up if you're not already registered)

- go to receipts on the left menu

Any outstanding debts should be shown here.  I check mine every time the community fees are due and paid, and so far so good.

Some might argue that if there are no debts listed here then thats the end of the matter.  I don't subscribe to this and believe that all outstanding fees should be paid otherwise the onus falls on others. (I also believe persistant debtors should be denied access to the resort but that's for another time).  However I would suggest that if anyone does owe community fees and they are not shown here, and they have only recently been informed of the debt, then any late payment penalty is arguably not payable.

Thanks for that info about the community website- we have been registered for a long time but I haven't been able to access it for ages. So......sent for a new password which arrived in minutes and was able to login. Then checked the receipts, which we hadn't done before and is a useful way of checking your payment has been recorded. Also looked at the list of owners who have registered with the site which was also interesting in terms of seeing new neighbours or where a property may be owned by a property company at the moment..

With regards to any outstanding payments I have a vague memory of an extra payment being taken around the time being discussed, and our CC payments being staggered slightly differently during that year to accomodate this- if that helps jog anyones memory.
