I am trying to get together as many people as possible who purchased a property through Andalucian Dream Homes and were given the complete sales pitch by their sales team.  I already have one lady who has put deposits on 4 apartments; none of which are completed.  I was purchasing a penthouse in Marina; I have more chance of finishing the development than they have and as yet, after two years, still cannot get my money back.  Are there any other people out there who are in a similar position?

Sorry to hear about your problems I was buying at Marina but last September, when the contractual deadline had passed, my solicitor took steps to execute the bank guarantee and I eventually got my deposit back from the insurance company at the beginning of January. Can you not do the same?

Hi,

Thanks for your response.  My contract expired on 30 June 2008 and I asked my solicitor to write to the developer's insurance company, ASEFA, to evoke the bank guarantee.  ASEFA would not respond and we are now into litigation with the compensation claim on top of my original deposit payment.  The courts in Marbella are packed solid at the moment and i was hoping this would go ahead in March.

Which lawyers did you use?  Did you have Lawyers of Spain?  I changed them once i was informed that they actually worked exclusively for Andalucian Dream Homes and only had their interests at heart.

Hi Lin

I was with lawyers of Spain. I never heard that they worked only with ADH. I twice got them to change the lawyer working on my case. The last one was much more helpful and proactive. It took a while for the insurance company to accept my claim but they never argued that I should not get the deposit back so I don't understand why your case would be different. by the way, Lawyers of Spain also acted for me on my new purchase on another development, nothing to do with ADH.
