Hi All

This is my first thread so bear with me....I put a deposit on an apartment in July 05 in block 17 and was promised a sea view which was my only real preference....i went to complete last year and found that there was an extra block built onto the block in front of me which now obstructed my view totally....I have had lots of communication over a 6 month period and still nothing is sorted ....i wanted my deposit back but was told I was entitled to 5k (deposit 60k) and am still stuck with this apartment....I have not closed yet but was hoping someone would have any advice.....

Do you have anything in writing saying you will have a sea view?

You purchased off plan I assume and if you did, plans are subject to change so I think you may have a problem. You may have to look for another reason to get your money back like late delivery. So check your contract.

We have bought in block 17, having also reserved the property in early July 05. I am a little confused though as the block in front of block 17 had already been erected at that time. It was only block 15 which overlooks the golf course & block 16 behind that had not been started. Niether the agent we bought through or Ros y Falcon made any guartantees to us re views and were at pains to point out that we only might have a view. In the event we do have a reasonable view of the coast towards Estapona. We were told that to be sure of a view you needed to be on floor 2 or above and the price of the apartments on the upper floors reflected that.

What level are you on, would they negotiate on a move to a higher floor in  block 17, or one of the other blocks that might give you a view. As Manilvajl says otherwise I think you may have a problem.

I think like John says you may find the developer keen too save the sale by agreeing to let you choose a more favourable apartment.  To save our sale when we were considering puling out due to late delivery they agreed to pay taxes for us.
