Jeff layton and myself are meeting with AEA and RyF to discuss the road subsidence at the end of February. I am sure there are other issues you might want to raise so can you add them here

I am not sure we will have time to cover every issue so Jeff and I will endeavour to raise the major issues as priority...starting with the road

thanks for the oportunity to ad some problems.Painting is not acceptable in some bloques,it will be redone.dogs and cats make a horrible noise every night,in bolque 7 bajo an owner lives with 3 o 4 dogs,sometimes there is no body at home and dogs are in terrace barking several hours.we are living in a quiet community not in the middle of the forest where everyone live as he wants.thanks a lot.

EGM April 2009 Agenda

Please add below items that you would like to be included in the agenda at this meeting.

In order to provide AEA with an acceptable submission please put your name and apartment number below each item you wish to be included.

1. The President to provide the meeting with an updated report on the repairs to road and pavement subsidence below block 6 and in particular to provide the agreed project plan with dates for completion the remaining work.

2. A.E.A. to explain to the meeting their procedures on keeping owers mail and pacticular AEAs policy of disposing of post not collected within a specified period. The meeting to be invited to propose a motion to modify the period that post is retained before disposal by AEA.

3. The community shall put in place and publicise before the 1st June 2009 clear and enforcable rules concerning the use of the community pools and surrounding areas. Special regard shall be given to the use and reserving of pool sunbeds and clear rules concerning eating and drinking in the pool area."

In the peak season of 2008 some owners reported incidents of selfish behaviour when guests placed towels on sunbeds but were absent for many hours. This became a problem for pool users who could not find available sunbeds (that were not used or "reserved" with towels). When some people moved towels from the unused sunbeds they were subject to abuse when the owners of the towels eventually returned to the pool area.. It seems that many guests believed that they had the right to reserves poolbeds with towels. These situations distract from enjoyable use of the community facilities. There should be clear rules that are represented with signs around the pool areas. We need to act quickly to prevent these unpleasent situations from arising again this summer.

4. The community directs that the remedial painting of blocks 1,2 & 3 (which was promised long ago) should be contracted to be carried out early 2009 - before the start of the holiday season.

Hi

Can we also make sure that there are plenty of sunbeds for each pool.  There were only 19 sunbeds around the Bloque 10 pool last June which was less than the previous summer and totally inadequate.  It takes so long for things to be remedied so  I reported this to AEA in June as I was concerned that there would not be enough beds for the busy July and August period.  I'm sure that if there were lots of beds then people wouldn't feel so desperate that they had to reserve them.  Why do we have so few sunbeds anyway.  Other sites have plenty but we seem to be limited to a measly few.  It can't be due to lack of space for them as there was certainly room to lay out more beds.  We didn't manage to get a sunbed during the time we were there and had to resort to buying our own.  Will the 2 new pools be in operation this summer?  We were told that the Bloque 18/20 pool was waiting for a licence in March last year but it was still not open last summer. 

I should be grateful if you could add our concerns to your management meeting.

Good sunbeds can cost up to about 100 euros each. This cost would have to come out of spare cash the community has, and I don't think we are in that position or a one off cost increase to pay for them. To cover full occupancy you would need 2 x 750 apartments i.e. 1500. I don't think we will ever have more than 33% occupancy at any one time, (but I may be wrong) so that is still 500.

The supply of sun beds is not something a developer normally funds. In small community we take them down or leave them at the pool when in residence.

I will discuss at the meeting next week.

"Problems After Purchase
 
Newly finished properties often have defects that aren’t visible
immediately after purchase or defects that appear with time, e.g. cracks in
walls, dislodged tiles and leaking pipes.
 
Under Spanish law, the developer,
builder and architect are legally responsible for the following defects and
obliged to correct them at no cost to the owner:
 
a) minor defects (defectos menores de construcción) such as cracks in
walls or ill-fitting windows: the developer is responsible for these for up to one
year after the property is sold.
 
b) medium defects (defectos medios) such as problems with subsidence or
sanitation: the developer is responsible for these for up to three years after the
property is sold.
 
c) structural defects (defectos estructurales): the developer is responsible
for these for up to ten years after the property is sold and must produce an
insurance policy (seguro decenal) covering these when the property is sold.
If you discover a defect in your property, it’s important to notify the developer
immediately and he is legally obliged to rectify it as soon as possible, but in
practice many developers don’t and some even turn a blind eye. In this case,
your only alternative is to start legal proceedings against the developer and arm

yourself with patience as these proceedings can take months, if not years!"   End of quote.

Questions

We would need to get independent surveyor to advise if these were structural or gnerated by settlement/subsidence.

Before a survey (should we decide to fund one) did we ought to consult all members of the community.

Should AEA write to all owners asking them to report anthing?

Should we leave it a few more months or  do we need to act quickly.  I 'm unsure of these points.

As Promised...a summary of the meeting Jeff and I attended with RyF and AEA primarily to discuss the issue about the road, however we took the opportunity to discuss other matters.

I suggest anybody going to the AGM ensures that the actions are followed up by AEA.

Paul M...i tried to paste on our Wiki site but the action failed..the whole process just locked up.

  1. Subsidence
 
Gerardo presented the report from the engineer, which outlined the findings of his study into the cause of the landslip outside block 6.
The cause of the subsidence was excessive water run off and that part of the development being built on fill rather than being on solid foundations.
The engineer has sent soil samples away for analysis and the solution and fix to the problem will be underway as soon as the weather permits. There is no evidence of movement of block 6 or block 7 and the fix will be done and finished with landscaping to the front of the block.
Work should take 3 months to complete.
Action – GC will send to JC/JL a copy of correspondence from engineer to confirm that the status of the other blocks.
 
2.      Cracks and small repairs
 
All requests for Incoplan’s resident maintenance team to repair problems need to made to AEA and Gerardo. There is a team of engineers on site to carry out this work.
 
3.      Connection of electric supply to phase 3.
 
Now that LFO for phase 3 has been obtained contract for supply is being applied for with electric company.
 
4.      Noisy dogs
 
It is necessary to report to security who will report the culprits to the police. It will then be necessary to follow the procedure to denounce the owner to the police . After a number (5?) of denunciations the dogs are removed.
 
5.      Bank ownership
 
A bank is buying a further 75 units in phase 3. this will be over 200 owned by banks.
 
 
 
 
6.      Cost reduction
 
Sandra is working on a proposal to reduce the costs of the development by looking at energy reductions and maintenance changes for different parts of the year. Will be presented at next AGM
 
7.      Repainting
 
Areas of paintwork which need attention should be reported to Gerardo and AEA. However AEA are producing a report for RyF showing the areas of painting that needs attention. Incoplan will then complete the remedial work.
 
Action – AEA to report to RyF the areas for repair.
 
In the meantime AEA will propose a plan for the repainting of the development. This should be an agenda item of the next AGM.
 
8.      New Pools
 
RyF have applied for the licence to open the new pools. Hopefully they will be open by Easter 2009.
 
9.      Poolside cleanliness
 
Photos of the dirt around the small pool near block 4 have been sent to AEA for their action.
 
Action – AEA to advise JC/JL of the work to be done to remedy this issue.
 
10. Role of the lifeguard
 
The lifeguard will advise security if the situation arises around the pool, such as misbehaviour or glass bottles/tumblers being used , that he cannot fix.
 
11. Sun Beds and shades
 
RyF will provide sun beds for the new pools in phase 3.
Additional sun beds and shades will be at the cost to the community.
 
Action - AEA will provide quotes for 20 new sun beds and 8 new sun shades and present to the community.
 
Action - AEA to provide additional visible signs around the pools reinforcing the rules concerning use and reserving of sun beds and eating and drinking around the pool.
 
12. Barrier
 
The barrier is not being changed to operate independently coming into or out of the development due to cost.
 
Security should be encouraged to close the barrier and challenge all people who haven’t got the access device to operate the barrier.
 
13. Abandoned cars
 
AEA continue to report them to police however that is all that can be done. Perhaps if the barrier was in operation incidences would be less.

No repainting has been carried out on blocks 1 & 3 despite it being agreed nearly a year ago that this was down to RYF.

It is getting worse and worse and starting to make the blocks look shaby . Took pictures which I will send to AEA in the next few days

Can those going to the AGM ensure that this is brought up yet again
