There will be  a nota simple if the horizontal division has been made and an individual number has been asigned to the apartment. If you apply for that info the "finca registral" ( individual registral unit) will still be under the name of the developer.

Hi Guys.

I have got a copy of a blank Reservation Document from my solicitor.  I would like to post it on here as I thought it might be useful for some people (and perhaps suggestions could be made on how it could be improved) but don´t know how I can attach documents. 

Can anyone help?

Can you scan it, then post it as you would a photo? Don't know how else.

If it's in MS Word format and you want to insert a photo/graphic. Click Insert/Picture/File

Not sure about alm's suggestion, but if you click on the little Word logo when you open up a new "post reply" text box, you can copy and paste your Word doc using ctrl + V, then click OK. (I think!)

Justin - I have email the attached to you.  I don´t know if this constitutes a good reservation document or not, but it was the one given to me by my solicitor.  If anyone can think of any additions/amendments then please speak up as I am hopefully going to be signing one of these things this week!!

En su propio nombre y derecho y se reconocen capacidad legal necesaria para el otorgamiento del presente documento, lo que llevan a efecto bajo los siguientes:
ANTECEDENTES

Me too although my Spanish nowhere near as good as Robs - to give yourself total peace of mind you could ask your brief to give you an English translation as well

My Spanish is pretty good, and I understand the contents of the document.  However, I am not a legal person so I don´t know what clauses should and shouldn´t be included in one of these documents, in the same way that I wouldn´t know what constitutes a good legal document written in English.

I guess it would be good if someone who is legally qualfied can say whether this is a good example of a reservation document or not.

I notice it does say that the seller will have to pay you the deposit back, doubled, if he defaults, which is the usual blurb. Has anyone ever actually heard of this happening, and is any such contract really worth the paper it's written on anyway? My recent purchase went a couple of days over deadline because the seller (or rather the seller's useless lawyer) couldn't get their sh*t together in time, but when I mentioned about this clause, it was just completely ignored. If I decided to try to enforce it, would I have just been p*ssing in the wind?
