Just to let you know that  around 1 in 20 non Spanish purchasers are now  part of  "I want my House".  We are beginning to act as a community now we want it built!

Hi All,
i just wish to share with you that i am pleased to be associated with you all. The sense of community and standing together to fight for our homes that is growing amongst us is truly inspiring. I have spoken to Brainmags about the standard letters and the aims of SARC and we both agree that we will put them together and send them to those of you who now make up SARC.
We will take your comments on board so that the letters and aims belong to all of us and not just Brianmags or I.
Next week we will start to do more and raise our profile and voices even higher.
I want to be your neighbour  and I want to enjoy a drink with you all.

“Administrators, apart from paying to creditors or negotiating with them the way they will be paid, they will be working to finish those projects pending to completion. It is even possible that a bank would be ready to finance the finalization of some projects in order for clients to complete the purchase and in that way, they would be getting cash money for the company. Therefore, not all creditors will be paid in cash or in properties. Each one will have a particular treatment.”

“FYI: I happen to know that the license issues at Santa Ana are no more. The resort as a whole is composed of several pieces of land owned by different people. There was one of those pieces of land where the owner reneged on the sale and this has caused the delays with achieving the full building licenses. The expropriation of this land has been a long process but finally got agreed in January this year. Santa Ana, in the meantime had already been granted licenses to start works in so far as the foundations (I have a copy of this). This is why they have built lots of foundations and haven't gone any further.
It was obvious that the town hall would not have granted a license to begin works if the full building licenses being granted was any more than just a paperwork issue.
Now that the expropriation has been fully agreed, the building licenses can be granted. The only hitch is that a deposit of several millions has to be made with the town hall to underwrite infrastructure costs before the full paper license can be issued.
Part of the liquidity that the developer needs at the moment is to cover this.
In financial terms, Santa Ana at the moment constitutes a load of deposits which is on average 30% of the total sum that would be received on completing the properties therefore it is logical that any reasonable effort would be made to turn all these 30%s into 100%s which means completing the properties. However, I do understand that this is purely conjecture because no-one can see into the future. This just seems to me the most logical option that an administrator would consider”

Hi All,
I have drafted the standard letters , the SARC mission staement and aims and objectives. These are with Brianmags in prepartion to send out to our members. I have set up an email address for SARC and I have asked a graphic artist to design a logo for SARC. I have been contacted and have been offered information and advice on how to approach the administrators.
BE POSITIVE. I TRULLY BELIEVE THAT I WILL GET MY HOUSE AND SO WILL WE ALL IF WE CONTINUE TO STAND TOGETHER.

To All just to verify what tonymal said ,
            those who have joined the I WANT MY HOUSE campainge and any other purchasers who wish to join this campainge and become members of SARC please email privatley to Tonymal or myself and with plot number and type of property and we will include you in the mailing of a set of standard letters which we have finished drafting along with a campaine LOGO letter head. Be for we send out final letters in a PDF format we will obviously send the drafts for your approval.
         We are sorry for delay but we need to get it right before sending them out so that the letters will be able to be used by all members  no matter what the type of House they have. I have put together a spreadsheet with what details I can gleam from the site.

We will continue with trying to get the project finished and our houses.

Tony is getting the letter translated into Spanish for those in spanish purchasers it they wish to avail themselves of it. we have also put together a mission statement for SARC as a group

Dear Editor,

I write to inform you that since my letter last week, which you kindly published, the Santa Ana del Monte Residents Cooperative, SARC, has been formed to represent member purchasers.

The number of members is growing rapidly and we are finalizing several documents including a mission statement, aims and objectives plus standard letters on SARC headed paper.

The documents will be translated into Spanish and available to SADM purchasers to enable them to join SARC and the ‘I Want My House!’ campaign.

An email address has been set up and a web page for the download of the documents will soon follow.

I hope that your paper will support our action on behalf of the purchasers who wish to have their homes and the Santa Ana del Monte Golf and Country club completed as soon as possible. We do not wish to pay solicitors to get us our money back.

I’ll tell you what we want, what we really, really want: “I want my house!”

Thought this might have been overlook and of interest from 10/06

Hi everyone,
Have just got back fro Spain this afternoon,having had meetings with Pilar,and my solicitor(Anabel at PSI)
We both feel alot better,in the fact that both Pilar and Anabel,are around 99% certain that all is going to be ok.The report from the auditors is due out in about 40days time,and it is then that we will find out 100% if the project is going to go ahead.All of the rumours in Spain,amongst the Spanish buyers,is that it is going to go ahead.
What Pilar and Anabel did stress,was that to make sure that your name is on the list of creditors,just in case,and Im pleased to say that ours was.Everybodys solicitor should have a list,and they are quite willing to show it to you.All the talk about having to pay solicitors up front to represent you,in my opinion is poppy cock,as we have both known anabel for a while and she hasnt asked us for any money,of course we will use her if and its only a big if,we have to.
We visited Jumilla,and work men are still at work there,and since we last visited the site(January)there seems to be a bit of progress.
If anybody else has any more news,please let us know

Hi All,
On the 9th of June SARC emailed the Directors of San Jose asking for some form of compensation for purchasers who proceeded with their purchases. A reply was received later that day and we were informed that Almudena, the MD, discussed this with the administrators. The reply was that new purchase contracts, which would include compensation, would be made available to purchasers who wished to proceed with their purchase, as soon as they had established the completion dates.

This is a very strong indication that SADM is going ahead and underlines why others who have been in contact with San Jose are very positive and the staff are 99% sure that it will be proceeding
 
Please note:
SARC does have the names of the Administrators and has already established a route of communication, this was done last week.The listed debt of the companies is around 30 million Euros with assets of 300 million and contracted sales returns on SADM in the region of 200 million Euros. The foundations are in for many of the properties on the west of the golf course, which has already been landscaped and had planting taking place.SADM is a legal development with 50% Spanish purchasers appealing to a different market than that of the coastal urban sprawl.
 And I ask: 
When you are offered a new purchase contract for your property what are you going to do? You chose SADM for a reason and you need to ask yourself if that reasonStill stands plus how you will feel seeing SADM built and not being there

I responded:

"staff are 99% sure that it will be proceeding" - Is that the same staff that didn't know administrators were being appointed, now all of a sudden, they now what directors and administrators knoe. Isn't that illegal as the report hasn't yet been published?

"The listed debt of the companies is around 30 million Euros" - I thought that this was the figure that they defaulted on payment on and not the total debt?

How do they know that figure when not all claims have been submitted?
That obviously excludes the deposits, so where have they gone?

"assets of 300 million" - That valuation carried out by SJ?

"You have very negative view based on many assumptions" - Am I alone, when the Administrators have not yet reported?

You run a so called campaign to save a company and a development, without knowing what the total debts and assets are of the company, then say  "I believe that you are going to be proven to be totaly wrong".
What is that judgement based on when you do not have facts?

Many on here claim to have Bank Guarantees, so they are not too worried. Surely if the Administrator is aware or has been informed of that, which one or other he will have been, is he likely to be too concerned about the purchasers who have such guarantees, therefore other options, when compared to what unsecured creditors are facing?

Do you know what the procedure is when Administrators are appointed?
Do you know what the total debts of the company are?
Do know how many hotel groups who would consider developing the hotel at present?

You continually choose to avoid accepting that there are such questions to be researched, before running a campaign, which you requre the Administrators to take seriously.

Would you at this moment in time, or say in 3 months, risk putting a deposit on another property on this development, assuming it was to go ahead?

And wait in hope?

Hi Tony, can you post the reply on Forum please.  Sorry if ive missed something but what does  'those who have proceeded with their purchases' mean.? No one can proceed with anything as far as Ive been told by SJ today not even safeguarding their money by completing on a 'key ready' property.

The reply on the 9th of June from the MD, can we see it please?

Hola todos,
It is again stated that 50% of purchasers at Santa Ana are SPANISH.  Where does this info come from ? Have San Jose confirmed that ? Has anybody who has seen the list of creditors confirmed this figure ? I think it may be wishful thinking on someones behalf.
Can anyone confirm truthfully the % of Spanish purchasers on this  development.

So, the reply was obviously not from the MD, but perhaps another member of staff who is aware what goes on at director level and with the Administrator.
Does this mean that the details being held by the admins, are being leaked like a sieve?

What exactly is a new purchase contract?  Is it one that replaces an existing one or one for a new sale of a property.  Either of these have no compensation to pay because they are new contracts so its hardly a concession is it?  Whats it mean, are the sales force back in business?

To get back to reality a bit, what compensation is there for contracts already broken? and what charges are recognised for legal fees we have to spend.
