 I would just like to support Steve - Palomares is lovely - though I think I would give Villaricos along the road the edge!!!  I also just wanted to say that the accident was very well documented when we were looking, though the agents did not mention it.  It would have come up easily enough and is regularly updated in the English free press.   We actually went for a place closer to Mojacar, because we love the playa and the pueblo so much.  But we are regular visitors to the areas around Palomares, including one of the most beautiful markets in the whole region, right on the sea front at Villaricos.   The only thing I would say Steve, is would you not consider buying now?  You could get some fantastic bargain compared to when we were all looking at ACC!!!!!!!    As far as we are concerned, the area is still a fantastic choice, and we have not noticed anyone glowing either!!!!

I have just had a phone call from Spain (10/10/11) and unfortunately it was very bad news.  Charles's (the one who lives in Northern Spain) sister, Marlene (who transferred to MCC), unexpectedly passed away today.

Hi Peter,sad news, so sorry to hear that.

How are you anyway, have you made a permanent home in Spain yet.? Do you remember Judith and myself, we met you for coffee on Garrucha harbour. Am i right in thinking you opted for a property on Mazzaron? We have been out here for 2 1/2 years now living in Palomares near Desert Springs golf course. It would be good to hear how things are with you.

NEW MAGISTRATES' COURT RULING WHICH SENTENCES THE BANK TO REFUND DEPOSITS UNDER THE PROVISIONS OF A GENERIC GUARANTEE /NUEVA SENTENCIA DE LA AUDIENCIA PROVINCIAL QUE CONDENA A UN BANCO A DEVOLVER EL DEPOSITO A UN COMPRADOR A PESAR DE NO SER ÉSTE BENEFICIARIO DE UN AVAL INDIVIDUAL
The Magistrates' Court from Burgos has sentenced again a Bank to refund the deposit to a purchaser under the provisions of a generic guarantee and the 57/68 Act. The Court understands that the lack of delivery of an individual guarantee to the purchasers, the lack of payment of the deposit into an special account, or the "supposed" lack of knowledge of the purchase contract by the Bank, are not enforceable against the purchaser, because those are developer's duties, whose breach can't affect the purchaser, as long as he fulfilled his contractual obligations. A copy of the sentence is attached..

La Audiencia Provincial de Burgos ha condenado nuevamente a una entidad bancaria a pagar el depósito a un comprador en base a la suscripción por el banco y la promotora de una línea de afianzamiento y a lo dispuesto en la Ley 57/1968. La Sala entiende que ni la falta de individualización del aval, la falta de ingreso en una cuenta especial, o el supuesto desconocimiento por el Banco del contrato de compraventa son cuestiones que puedan afectar al comprador, cuya obligación al respecto se limita a cumplir con el calendario de pagos estipulado en el contrato, siendo el promotor y, en su caso, la entidad bancaria, los obligados al cumplimiento.
Se adjunta copia de la sentencia.

Yep, swapped to MCC, and not regretting a moment of it

 

Although I've now retired, I still live in the UK and holiday in Spain (you can have too much of a good thing, you know)

 

I've just returned after a month out there, and plan to return mid January.  I will contact you nearer the date, to see if we can arrange a meet - maybe Iain (diver dan) will be out at the same time.

Wondered when you would see the post!!

Will be out late November early December for last week this year not out till February next year but yes keep in contact and we can meet up for a chat.

So sorry to hear about Marlene. Is Charles still going well with his young family. I suppose they won't be that young now!

I thought Jeff was out in the region somewhere Vera or Mojacar renting.

So you have finally retired well good for you I am still working but who knows I might manage to retire soon...........

Last I heard, Charles is still DJing (he must be 70+ now).

 

I have lost touch with Jeff, last seen in the Turre area.

 

I can recommend retirement - although I'm too young, and far too poor, to do it properly (but if one doesn't try...............)

Hi Everybody

We paid up in 2005 just before Huma pulled the plug on ACC. We were fortunate that we pressed our solicitors to get a bank guarantee, and later to execute it. So we lost our 3000 euros and any itention we had of retiring to the sun. At this stage of economic uncertainty I would only ever rent abroad particularly in non industrialised countries like Spain, where corruption sems to be endemic

I Feel very sorry for those buyers who waited in the hope that those nice people at Huma would do the decent thing. Perhaps when Spain has to go cap in hand to Germany they will put someone in charge who will shake up the old system and we'll see some sensible judgements. Don't forget, it wasn't just the British who were fleeced, the  purchasers were from all over Northern Europe.

Donald's site kept us sane, with contributions from Charles and Peter and sound advise from Maria.

Hi we are new to this blogging malarkey and thanks to Justin pointing us in the right direction we have found you other ACC investors. We invested in 2004. We have a civil case against Huma, going through the courts in Totana, which is painfully slow and didn't help that Huma had moved to the province of Granada. This has all been going for 2 1/2 years, we had a decent lawyer on the case and then she left the practice and her replacement was useless, so we have given our case to our lawyer in Motril, costa tropical, also province of Granada. ( The Totana court also lost all our case notes for a couple of months, is there no end to how incompetent this countries justice system is ? ) we realise if we win the civil case, that this is not the end we will have another battle to get our money. In the meantime our new lawyer who we saw yesterday is contacting the bank CAM and then we are going for a criminal case against them. We had a bank guarantee. Any feed back would be good ? will keep you posted if you are interested. We are living in Spain (mostly ) and are in Salobrena, Costa Tropical, anyone near by ?would love to meet up.

From mosy reports those who have a bank guarantee have been paid- some with interest and others not

As soon as ACC was cancelled your lawyer should have made a claim against the bank guarantee [ I assume  you have the original] and not Huma

it was always the only way to get paid

I know from my own experience with another development that once it is stopped it should only take circa 3 months for the banks to pay on a BG including interest-my costs were only 1000 €  

CAM bank are now in trouble and the Bank of Spain are trying to get someone to take them over, so they may  stall on everything at the moment but they will know that they have this liability to you and probably already made a provision in their accounts

if you keep at it you should settle with the bank only for the full amount plus interest at circa 6% and legal costs

the initial 3000 € reservation fee will not be included in the BG

Interesting that Huma have moved to Granada

Good luck and from what you say , you should be able to exercise the BG and get your money back relativley quickly

So sorry to hear about Charles Sister Marlene we are on MCC and met her when she first came to MCC. I have only just got back on to ACC Forum and it really shocked my Husband and I.

It is such a shame all the trouble and worry that Humo caused for Marleme and loads of other people that this should happen.

Do hope you are well Charles so sorry to hear about your sister  I used to like to read your messages on the forum felt like I knew you.

I met Donald and his wife ages ago and i believe he was getting a bungalow built in Antes area - do you know if he did and does he stay in Spain now?

We are out again on Saturday for our last week this year so  looking forward to that.

Steve is the Oasis open and is Ken on the mend?

Hope the weather is good and dry a change from dear old Scotland.

  Hello John,

Sorry could not reply to your message I have asked these questions and was told Huma do not own MCC it is owned by its home owners.

They are still technically responsible for the finishing of MCC but with zero funds that will not be completed by them.

The offices have not been locked up, indeed there is someone there  from the Subiely family most if not every day and Cartagost

who supply us with our internet TV ect work from there every week day  I did not get an answer about Granada. Are you one of the unlucky ones who did not get your money back like myself and loads of others from Huma.

Still not getting anywhere - but the whole thing is now complicated by Huma going into liquidation.

Some lawyers still believe that suing the banks without a BG is the only route forward.  Not much evidence of mass success or even minor successes.

Suggest you go down a NO WIN NO FEE basis for future action - though many still want an upfront fee of up to £1,000 to represent you. Not always totally NO FEE.

Do you have any details re. Huma's liquidation?  I have searched, high and low, and can't find any (probably looking in the wrong place / asking the wrong people ).

 

The problem with 'no win no fee', is that they have no problem winning; it's getting the money of Huma that's the problem.  If a lawyer was to win you 50000€, he would want his 20% (10000€) as it's not his problem that you can't get paid.  What's needed is a 'no payment, no fee' agreement (just watch the lawyer's face if you suggest that )

Here we are talking about suing the banks not Huma.

Huma  Med have no money according to their accounts (I saw their accounts 2-3 years ago obtaimed by my lawyer and posted that fact here then) - but the Banks do if you win.  Harder to win against banks - I presume - with their expensive lawyers!  I am not sure if Huma liquidation would hinder any case against a bank.

It was our lawyers that told us Huma were bust. Not sure if that is breaking news in Spain - there must be property companies going bust by the hour over there!!
