The frightening thing also is that as mentioned, they only need 51% support, so let's hope directors, subsidiary companies, family members, etc., did not buy into the development, as is often the case, as a way of raising funding on the strength of the number of 'sold' properties, as it would reduce the numbers of 'outside' purchasers needed, to get the 51%

I am still at a loss as to what we are actually being asked to vote for.  You say that we are not voting yet as to whether we want our house or money BUT if most people vote for their money back at this stage, then they know there is no support for the project.  If you vote to say you want your house, whose to say you are either committed to this choice or at least have your money tied up until HdT / SJ decide to pay us back?

If HdT/SJ are not having their hands tied by the administration process, then god help us all.  they have already shown that they want to pay money to start yet another development - it was only the administrators that stopped them.  Where was this money going to come from?  OUR DEPOSITS most likely. 

In my own opinion, if HdT / SJ go into liquidation, we have little chance of getting our money back.  If they come out of administration, then they are going to spend ALL our money.  Rock and Hard Place

Hi Alantracy,

             the administators and compnay are drafting the proposal it will be a leagaling binding agreement from the administrators & company the courts will enfoce their agreements that they propose so security in that knowledge.

(cant be exact on full details yet but will update as soon as we know)

there will be repayment options for those who wish to get their money back

and enducement and options for those who wish to continue with the purchase

      if we agree to the proposal as a whole then the aministators will ensure acheivability and this will be our only opertunity for all of us to get what we want

As a purchaser HdT will have your details & should be sending you the settlement offer letter when it is ready. If you conctact HdT I am sure that they will tell you this & the 'phone number is in the report.

I suggest that you contact some one other than "man at the council", perhaps HdT or your solicitor or even the current issue of CBN. I appreciate the written style and the message that you are trying to convey  I also suggest that it may be prudent to await the settlement offer before being so negative.

Hi Wajid,

I like your literary style & your attempt to relay a negative message, however, if the man at the company did not think they were going to build they would not be preparing to give present us with a settlement agreement.  So I suggest that as you have now added "law man " and going to the big boss at the council to your lines ,that perhaps you wait for the settlement offer.

Hi All  any news on this  agreement ? Do we know any more about it ? Has anyone been contacted by SJ/HdT directly or via their lawyer  regarding this ? Are hundreds rushing to take up the offer or is it just Tony and Brian ?

Considering this quote from the SARC report 8th October 2009 can we take it that things are not going well ? 

 

 "The resolution offer will be ready in the next few weeks."

Hi MM

Contacted my Solicitors about this proposed settlement agreement, they have heard nothing about it! Suprise suprise!! They also advised me that I shouldn't agree to anything direct with San Jose it should only be through the administrators. But its irrelevant to me as I have cancelled my contract with San Jose and this has been verified by the courts so nothing that San Jose say to us means anything. Nothing new there then eh!

I think that what was told to SARC at their last "meeting" was bulls**t designed to appease them and give them yet more false hope. Just my humble opinion of course, befor eI receive the useual slagging!!!

I have spoken to my Lawyers about this agreement also.  They had also heard the 'rumours' but have not been contacted by SJ / HdT or administrators.

I will only believe what I can see/touch and nothing else

Hi all 

 I agree with Dave my lawyer has advised the same .It all seems a bit underhanded SJ/HdT are once again trying to  delay  the  inevitable in the hope that  they can some how  refinance and can carry on with their superb customer service and after sales practises  ie Nada   ( they quite  clearly are still unable to refinance or put a feasibility plan before the court nothing new considering their track record ! ) Lies, lies and more lies .

I would not sign anything! I don't think that SJ have the ability to finish Pinet and Jumilla is not going to happen.

The last 2 emails i received from SJ were condradictory as usual so i am still pessimistic about the properties being completed, also my agent was at court recently, all i know is that it did not go well for him, he is trying to appeal and that the situation with SJ is much worse than he thought!

As far as I know it was never down and never stopped  selling . Many agents and websites have been advertising SADM throughout all the trouble therefore I don't  think it is necessarily a good sign .
