Hi blaggy,

I had an update on the siuation from my solicitor, she says the delay on the findings were delayed because some of the regestered claims had to be proven on what was acually paid as a deposit.  Can believe that has taken 5 months.

The administrators findings are now due end of June start of July.  We will see.

The way I read it is all claims have to be regestered depending on you choice

Have you deposit transfered, (no good in my opinion as still paying over the odds in the current market)

Waite and see.  Developers may get bailed out and SARK can get their houses sometime in the future. (can't see that either)

Ask for breach of contract and a full deposit refund plus interest and costs.  As my house was yo be completed by May 09 plus 3 months grace, that is the root i have taken.  They have not delivered as per contract and I want my money back.

Depending on what route you take will determin you status on the claims ladder mentioned on another thread.

If no backers are found and the company go into liquidation the assets will then be shared out to the claiments in order of importance.  It is also mentioned that as the company has it's main assets in land, and no onn wants to buy now it may take 5 years or more to get any money back.  This will probably be less than was paid in.

I am sitting on my claim because to my my mind there is nothing better on offer.  The time frame on my contract expires in 3 months so breach of contract, and if my bank guarantee WAS registered corectly ( down to the solisitors) I should have another legal cause of action.

There should be a lot of other people in the same position as me and depending on the outcome may want to join forces in a class action.  I have already hade pm's from others in the same position.

I have mot posted here for some time as there was nothing to post about, and I am not interested in the bitching goind on. mayby from pure frustration.

What I have said here is based on my understanding of the update from my solicitor.  Start pressing your solicitor for info.

If anyone has more or different info please post it so we can all support each other in this nightmare.

Hi Recardo et al,

I was also informed some time ago that the delay was due to claims being proven, but to me this is just another smoke screen and delaying tactic.  Why the administrators can't move forward and make some decisions is beyond me.

My contract was breached in May 2007 when my property was due and went through the process of claiming my money back and had to go through the process of sueing them.  This was then put on hold due to the administration process.

Everything this family has touched has been criminal, the legal support we seem to have received is mostly pathetic with the power of a wet lettuce.   Writing to MEPs has proved fruitless and most couldn't give a toss so long as they can keep putting their hands in the honey pot. 

I'm getting angrier each time I come back to this point, I've tried to stay away for a while for peace of mind, but need to let those concerned know I'm not going away.  I've even wrote to my solicitor in spanish so he can't say he doesn't speak English as an excuse for the lack of information.

It has also come to my attention that a certain company were able to buy a number of properties at 50% of their value and are now trying to sell these of at "discounted prices" (Oh and I believe that don't I).   Oh! and apparently this agreement was made before SJ went into administration.  I'm sure SJ would not have sold anything at discounted prices when times were good, so this is more crap. 

Where will it end, god only knows, but I know one thing, I will continue to persue what is owed to me.

Have not been on the forum for quite a while, have given up on it all really.  My solicitor says however that the list of creditors has been released but she has yet to forward it to me.  Does anyone know how I can get hold of it?

Hi Redman,

you want to keep chasing and i assumue a lot of other people do.  Your date is 2 years earlier than mine and so much more frustration.

We can only wait till end or June ( if not delayed longer to se what is happening ).

If  nothing is in our favour I am prepared to put in another grand of so to file a clase action against the bank the company or the solisctors for miss representation. If others feel the same it is better for 20 people  or more to pay a grand than  one person to pay 20 grand or more.  I thing they feel we will go away if it takes long enough so drag it out.  I hve close to 50k Euros invested and I want to keep chasing everyone involved.

Redman you are like me a dog with a bone, and I want to chew it, because we have been screwed.  We have contrcats , legal advice, and done things according to the Spanish system and they turn their backs on us so we should fight.

Anyone feels the same as me send a pm and we can form our own WANT my mony back club and chase the b uggers later.

Hi All,

I understand your frustration with the on going mess and the wieghing up of probable outcomes.

Any news that we get we place on the SARC website and the posting of  Recardo confirms the timescale plus the reason for it, that is in the SARC report.

I believe that it is important that those of us without BGs realise that our position is different to those with BGs and that the best option for us is SADM being refinanced.
