Hi All,

I am sorry for the delay in the report coming out. I have been down with swine flu and and out of action for a couple of weeks.

The SARC webmaster has a problem with his PC and software, therefore there is a delay in getting this posted onto tthe SARC website and I have posted it here for all to be able to read:

July/August 2009 Report
 
 
On the 30th of July 2009 Anthony Malpass, on behalf of the SARC membership, met with Almudena to discuss the position of SADM and the following information was given and or discussed:
 
 
Calaspara
 
 
 HdT wish to sell some more land at Calaspara and the administrators are writing a short report to present to the judge to ask permission for the sale to proceed.  Almudena was very positive that the sale would be approved.
 
Jumilla Town Council:
 
 
HdT met with the Jumilla council the week prior to our meeting and discussed with them the way forward for the SADM development. The council wish for the development to go ahead and HdT have been discussing with them, ways in which they could help the project to proceed.
 
BBVA:
 
 
The BBVA Valencia office has been negotiating with HdT regarding the refinancing of SADM. The court gave an extension to the administration process to allow these negotiations to proceed. The Valencia office has been checking documentation (which the court authorised to be made available to them) and a deal is on the table. They are awaiting a reply from   BBVA head office in Madrid.  Almudena was very positive of the outcome.
 
 
Murcia Regional Government:
 
 
The regional government are going to purchase some land from HdT, as part of the construction of the new motorway.  HdT are seeking to get the payment from them ASAP.
 
SADM Build:
 
 
Almudena was very positive about the refinancing of the development and said that as soon as HdT had the money that they would apply for the licences, which would take a few weeks to come through. She also said that whilst doing so they would immediately recommence work at SADM, get contractors on site, begin preparatory work and have materials delivered, to enable them to start building as soon as the final build licence was received.
 
 
 
 
 
 
Purchasers:
 
 
Almudena stated that as part of the process; and as the negotiations mentioned above concluded, the purchasers would be contacted and given the choice to proceed with their purchase or not.  The letter would outline the repayment offer for those who wish their money back and also the “compensation” for those who wish to continue with their purchases. A Malpass said that purchasers were getting very weary of the process and that the SARC membership had voted on a discount as compensation for the delays and stress that the situation had caused. A figure was not given nor discussed at this time but it was made clear that the SARC membership would welcome and pursue a discount.
 
 
 
Comment / Opinion
 
This was the most positive meeting that SARC have had with HdT and Almudena explained that negotiating with all of the different parties had been time consuming and hard. It can be seen from the above information that the negotiations are serious and that there is wide support for SADM to go ahead.
 
From all that has been said it now appears that a positive conclusion to SADM is very close and that building will probably recommence at the end of this year. It has been a hard 15 months for purchasers and we have had to endure negative rumours, which have never stood up to scrutiny but caused concern to many. The aim of those spreading the rumours appears to have been to make money out of us and our plight. There continues to be those who wish to make money out of us purchasers by trying to scare us but it is important that we ignore them, give them no credence and ensure that we do not line their pockets with our hard earned money.
 
It is therefore; the opinion of the SARC Executive Committee that the probability of SADM going ahead is high and it would be prudent for purchasers not do anything that could minimise their options at this late stage of the process and to be patient for a few more months. Furthermore, we still believe that SADM is an attractive and desirable development and hope that many of us will be neighbours in the near future.

Thanks for the posting featuring the report. It looks  positive for everyone. I hope they keep to there word and the build does go ahead, as this will benefit everyone.

Hi MM,

 No, Tony is'nt paying me. I was feeling a bit down and reading the reports contents, i am just grasping at any positive comments really.

In an ideal world we would like our money back, or at least something!!  The dream dissappeared months ago of ever living there, whether the build went ahead or not, the time has passed and like i said grasping at straws.

Wow, did you see that, a squadron of pink pigs flying overhead.

I can't believe there were rumours flying around about San Jose, unthinkable, unimaginable.  Would it be the ones about stealing the money from the poor people of Molins or was it about the money laundered from one company to another, or even the one about purchasers putting deposits on properties without protection.  No, can't be, they seem such nice people.

I am glad to hear the build is going ahead, I can now get on with sueing them for my money and legal interest. Best investment I ever made....

In all seriousness now though, the creditors meeting is unlikely to go ahead this side of Christmas never mind refinancing and continuation of the build.  Until this has happened San Jose will remain in administration and certainly cannot make statements until they have a plan to repay everyone involved.

Looking forward to the next installment, it does make me smile.

Can i ask one question, if almundena is so fecking positive why do they not correspond directly with us and put something in writing to say how positive they feel. Mind you if i was in her postion i would be positive as well, as they have our money.

How much longer tony do you expect us to sit tight and wait, with them it's always in another couple of months great news is going to happen, what happened to the refinancing in jan of this year.

Out of all the meetings you have had with almundena which obviuosly costs you time and money, how much of what they have promised over the last eighteen months has actually come true.

Alumdena does seem 'very positive' about lots of things

I am very positive that I want my money back. 

If SJ DO build, halve the cost of the properties, and promise me free gold taps - I STILL want my money back.  Promises are cheap, and are not worth the paper that the Bank Guarantess are (not) written on.

Dear Dave

I have never had a meeting with her, or as i said earlier have had any correspondence from her regarding the latest situation re the viability of any of san jose's projects. If this was realistic news (ie actually going to happen) and as a company you could see the light at the end of the tunnel, does'nt it make sense to tell all those involved we may have a way forward, and not leave it to tony to fly there have a meeting come back and type up what they think may happen.

Until i see something in black and white from my solicitor, i will be of the pessimistic frame of mind, you've got to admit eventually we will all have to get to the stage where enough promises that do not materialise is enough.

All i want and i'am sure the majority of people want is a definitive outcome and not more months of speculation over re refinancing (see january) i want my money back and then get on with my life.

Mark, I am with you on this. I like to think I too have common sense and not a puppet and that if SJ had such positive news, they would be shouting it from the rooftops, not letting the resident clown be the one to break the news.
If there was such good news and they respected their customers whose money they have held for so long, I am confident they would be more than pleased to inform all purchaser's lawyers. Probaably find they would bend over backwards to help build confidence.
Well, surely that is what those with common sense would believe. There again, you do have the others

The simple fact is that SJ do not have the money, no matter how much they keep saying that they are going to get it!

If they had the finance from the bank then it would not be hard to prove it with a letter from the bank stating this, it is easy to produce contracts for the work as these do not mean much to SJ as they just have to keep breaking them and getting away with it as usual!

Until i hear that such a letter has been shown to the lawyers then i am afraid i will continue to believe that we are still being strung along, they (SJ) must think the British people are stupid, a real insult to our intelligence!

I am sure we have debated all of this before  when SARC released there last report  "if it is good news why are they not shouting from the roof tops 

" Why are they not contacting customers and their lawyers with the good news " 

  "Why are they not doing press releases  heralding their good news "

We have all discussed and made these comments sooooooo many times before that  I am getting weary .

Here we go again !!!!!!!  A load of SJ bull . I for one refuse to swallow  any more bull .

Tony thinks he is some how in the know . He Knows nothing !!!!!!!! . In all the time he has been meeting with Almu he has learned nothing . He is a mushroom ,he is kept in the dark and fed bullshit . SJ are using SARC to make themselves look good to the judge and in the hope that it stalls some purchasers  from protecting themselves legally . All this is weakening our case .With each day that  passes our chances of getting anything back diminishes .We are just  buying SJ yet more time to shaft us and their creditors out of any chance of justice .

My advice let them know with the help of strong legal representation ,that you WILL NOT GO AWAY .!!!!!!!!!!!  MM
