I have also heard the same news which is excellent, I believe that the town hall are also providing a shuttle service to assist the elderly and mothers with small children in getting up the hill to Don Juan as the incline is in breach of European regulations.

I have heard that Jesus will be driving the shuttle bus.

In fairness to Corrie there has been some work done on the road but we think it is the developers' workers who have done it and it is just another temporary surface

Hi Cc

What exactly do you mean by normal. Being one of the first people to buy at Don Juan, it is now 7 years for this small 250 metre stretch of road to be completed since I bought my apartment. It's not about being negative, it's about the truth. To get a message like this on the forum regarding the road on Aprils Fool day ( 1st April ), a day on which the media and others make up ridiculous stories has to be taken with a pinch of salt. In case you don't understand what " a pinch of salt " means, it means with a lot of suspicion.

Maybe we should go around to the houses of the Secretary of State for Transport, Concepción Gutiérrez, and the President of ADIF the railway infrastructure company, Antonio González, and dig up their roads for 7 years and see how positive they would be about it. I in no way blame the current or previous committees for this delay. They must be so frustrated. It must feel like banging your head against a wall all of the time. If you ask me, it would not surprise me in the slightest if the road never gets done, as a new link road is to be built down in the valley beside blocks 6-10 to the new roundabout on the coast road N 340, so why would they waste money on this small section.

 This has been discussed many times. There is no question that road will be there, but the courtcase between the townhall and Adif has to be settled first. They don´t agree over the exact part owned by Adif etc. 

I recently spoke again with the townhall architect and he is sure it will be there, but first they have solve this dispute.

The rumour about tarmacing is a white lie by the developer. Every year they fill up the holes with either sand or pebbles and every year when the rain starts it becomes the same waste it was. This time they figured out a new trick: they spread loose tarmac to fill up the holese. It will end the same way as this tarmac is not hot melted. It just looks black and they can say that there is tarmac.  

There is standing court order that every construction work on the Adif property is forbidden so the promoter nor the committees can change that. There are possibilities but for that you have to know the details of the argument and that´s not to be published on an open forum.

Hi neighbours,

Ik think the developer did a good job trying to make the road a bit more acceptable.

It's not their job, because they don't own it, they are doing their utmost to make it as well as they can.

One day I think the road will be okay, we just have to be patient, how inconvenient it is for us, in time it will be fine, I'm convinced.

Again a request not to attack the developer on this thread, because I made it just for information and not for arguying.

I hope you didn´t refer to my post as I just explained why neither the developer nor the committee can do anything about it and like you I´m sure it will eventually be there.

The loose tarmac however is dangerous for scooters which many of the residents have and with a large suitcase it´s actually a nuisance.

Important points on the agenda are f.i election of president and vice-president. The current president is the daughter of the developer..

So it´s essential that you try to visit it or give a proxy vote to someone you trust. It can be anyone; he or she doesn´t have to own a property in DJ !

Presumably I will have to go there as I got a few proxies of clients, but as alway the best thing is to go yourself as it are your interests. Thing like community dished for English tv and garden gates yes/no are on the agenda as well.

A short write up about your AGM which I attended on behalf on owners in phase II. Except for one couple and me the attendants were all Spanish; the meeting was completely in Spanish

Nuria tried to intervene and refuse me entrance to the meeting but I came well prepared in cooperation with the owners so the administrator told her that just had no legal possibility to do so.

The actual proceedings of the DJ II AGM were very, very interesting. The owners revolted, the president disappeared during the meeting and it was decided to postpone the approval of the budget for 2010 as it was clear that a lot of money went into contracts with friends of the president and developer (one person as you will know). 

This postponed was disputed by the administrator acting like she was the president but also stating that the developer still owned 30% of the votes so there was no real majority although the vote to postpone the rest of the AGM (budget next year, election of president and vice-president) was unanimous. Don Juan jr. was put under pressure to state why he voted the way he did as he was a representant of the developer and not a member of the committee although he sat at the presidents table. He declared himself to be just a neigbour but by that time the meeting was completely taken over by a few people who had prepared it. Some even had other quotes prepared for most items on the budget.  I know who I would vote for as president. A person who prepared well, was calm but firm, had authority and didn´t become emotional but calmed down people when needed.

I succeeded in establishing proper contact with the key figures and tried to help them as good as I can, knowing our figures and knowing the law on horizontal property. They (more or less including me) formed a sort of interim working group of concerned neighbours.  We exchanged phone numbers and e-mail addresses. The rest of the details about this part can´t be published on an open forum, but are available for sincere owners of phase II properties by PM.

Meanwhile they had a serious questions about the expenditures over 2009 which unfortunately can´t even be discussed in phase I. They formed a control group who would check on the committee regarding expenditures with a representantive of every block. Again an achievement which unfortunately was voted against in phase I by proxy votes. It could be that the developer wil vote against this as well (actually I´m pretty sure of it, but I´m open for surprises).  

Meanwhile the president did achieve good things for the community. Se organized stuff which took us years or are still unsolved. There were serious discussions about how what money would be spend on which improvements. Again something which unfortunately is impossible in phase I. The security is very tight thanks to a guard and camera´s on every block recording everything. 

All in all a meeting like in the good old days of phase I with really involved neiighbours who were assertive. I´m very attached to my own house, but otherwise I´m almost jealous of the owners there. 

Now, I left a lot out as it can´t be posted, but there is one thing which can be done.

Make sure that the EOS readers and more in general the non Spanish owners are represented as well next time.

Nobody was even interested in discussing communal dishes as the Spanish Digital cable is excellent, but they would welcome active involvement from the non Spanish. I have promised them that I would do my best because that would be the best for this community which will go through hectic months now that there is an revolt against the developer controlling the community and paying friend to do overpriced jobs. The exact status and outcome of this meeting is unclear at this moment, but I´m certain that the owners won´t stop if they are outvoted.

EOS is one possible way to achieve active involvement, but luckily I know lots of owners already through email or by meeting them in person. Your community now needs active invlolvement, as they are facing the same problem phase I had in the beginning. We won that thanks for a well organized campaign and the complete cooperation between the Spanish and all the other nationalities. It would be very wise to make sure phase II can settle this as well. As long as the developer owns more votes changes, improvements the way you want it and cost savings are not possible.

Hi owners of Don Juan II,

I want to thank Max for his clear report of the Owners meeting, we were also at the Confortel for 4 hours (or more?). Also our German friends were there.

Unfortunately we did not understand it all, but it was explained to us about the trees and umbrella's etc.

It's a pity they want to raise the contribution. I hope they find a cheaper solution which everyone is happy with! We will not be at the next meeting but will give our vote to Alicia in block 3. She is a schoolteacher and wants a good community but not to expensive and that's our idea too!

 Unfortunately it hasn´t reached all owners of phase II. I spoke with a few who didn´t receive the invitation. I have a copy of them so if you PM me I will send them to you.

I will again be attending the meeting on behalf of clients in phase II. 

Make sure that you are all represented as this will be a very decisive meeting where the number of actual voters in person or by proxy will make all the difference.

Hi neighbours,

Just a question from a very hot Holland (how is that possible):

Does anybody know what type of document we need to fill in for the yearly interest tax?

We have to fill in 5 forms because we own the apartment with our kids (for death duties).

There are several different documents on the internet regarding the tax with different numbers, so if anybody knows the number I would be grateful! We are not residents of Spain!

 Hi Corrie,

Basically the simplest way to solve this is go a good gestor. We pay around 50E for it and we are certain it´s done completely right and timely to profit from early pay discount and residents account. (a total of 35% if I remember well). 

It´s no big deal to do it yourself but with a split bill as in your case a gestor is surely the best way. Even we, who read and speak good Spanish prefer to use the tax knowledge of our gestor as it´s quite cheap.

BTW: the mayor has promised no raises for the upcoming year due to the economic crisis.

The second part of the AGM of phase II after the strange end of the first part was a very disappointing sequel.
 
The neighbours had decided to use a rational instead of an emotional approach to the resistence of the developer / president. They had studied the proposed 2010 budget and collected even more alternative quotes.
 
They even invited one possible contractor for the maintenance of gardens and community to attend the meeting so that he could explain possible enquiries. They were even better prepared than last time. The president and administrator had also a new proposal which they handed out during the meeting. It was slightly lower than the first one, BUT there was a huge omission in it as the obligatory 5% reserve for communities was taken out of it. They mentioned that so this was just an effort to appease the owners, but in my view not only against the law but also against the interests of the owners. Without reserve fund when there is major damage to the roof or painting is needed there are no reserves and money has to be collected by extraordinary fees from owners.
 
Anyway on several main budget posts, alternatives as proposed by the attendants were discussed in detail. There were huge cost savings involved. At the end of a long meeting the budget of the president was put on vote. Only the president and the vice-president (the lawyer of Arrohabitatge) voted for it.
 
Then the alternative with cost savings was put to the vote and all the attendants (including you) voted for that. However Arrohabitatge, pardon me, the president used all her votes to block this proposal without any argument.
 
I know she wants to protects her friends with lucrative contracts and of course keep her adminstrator who only works for her interests and not that of the community. She charges twice as much as the serious well presented alternative administrator but Nuria didn´t even want to discuss it.
 
80% of the attendants then left the meeting as it was now clear to them that your president doesn´t care for the well being of the community. The actual vote for new president and the appointment of the old administrator for a new term were done without people voting except the president.
 
I hesitated what to do. Leave the meeting or not and decided to shortly leave the meeting and inform the neighbours who were not too enraged that there are legal ways around this abuse of power. However I went in when the ´questions´ started to be sure I was aware of the issues raised. Nothing of importance happened there.
 
Overall bad news for the phase iI community as fees will be raised substantially without any advantages to the owners. It was a real pity that this time I was the only non Spanish person attending. None of the foreigners had taken the trouble and as far as I could see hardly any proxy vote (except to me) was used by the non Spanish.
 
I have stressed how important it is for your community. I can´t do more. If there is no interest I will stop releasing these reports on EOS.

Again thanks to Max for his effort to keep us all informed.

We were not able to attend the meeting, but gave our vote to a Spanish schoolteacher, she was prepared to vote for us, as we share the same opinion.

We'll see what happens in the near future, last time we visited the meeting, the Spanish owners did not agree with the board.

So we cannot imagine they will accept the rules of the community.
