Completing a propety purchase. When paying any money to the Notary or builder make sure you get a  receipt  dated & signed on their company  headed paper.         Keep all the paperwork safe.           Make sure you have a Habitation Certificate & proper instructions from the lawyer before passing any funds over.  If the lawyer has not given these instructions then ask him where they are.

 Hi Maria,

I have a question for you on Squatters.

My experience with Squatters or undesirable residents is that in our Complex there are now 9 families who say thay have a rent book or permission to live in the empty apartments. NONE of these families are paying any utility bills yet break into the electricity room and turn the electricity & water on for the apartments they have lived in for the last year. The Police or the Administrators have not seen proof of this permission to live in the complex.

There are 16 apartments bought by private owners and many are still owned by the Builder and the Bank who has claimed half of the remainder as bad debt from the Builder.

The Builder has a company renting his apartments to undesirables who are distroying the building and causing problems for the three Families of Nationals who are purchasing via a morgage. Any damage the community fund is paying to repair.

The police have been called several times to report the damage these undesirables are doing. The Police say they can do nothing because the building has no Habitation Certificate. 

Several Owners mostly Non Spanish owners are not happy. They pay the 80 euro Monthly.community fee which covers the utility bills and hopefully to save for the work to be done that the Builder has failed to do. These undesirables use the facilities & utilities yet pay not a cent towards the cost. 

The 16 purchasers who over 6 years ago, did manage to complete and have the deeds or morgages to prove ownership of their apartment are afraid of many of these undesirables and do not approch them for fear of the violents actions they have shown in the last year. 

The Administrators & President of our community have worked tirelessly to seek permission from the local council to get approval for our Utility Meters installed (We all paid the Builder for this work to be done 6 years ago) and have failed because the council just do not do anything to help us.

The Bank who owns more apartments than the builder started court proceeding 15 months ago yet we are still in the same position. Are we the only complex with this problem

IF SQUATTING IS LEGAL THEN WHERE DO THE OWNERS WHO ARE SUFFERING STAND.   

Are other complexes suffering as we are.

Property standing empty in Spain,

Apart from 2 legal residents in a block of 50 apartments a third of the properties have squatters. The complex completed in 2007 is still waiting for the local council to provide the Habitsation Certificate without which we are unable to get individual meters for our investment.

6 years taxes could of been collected for the apartments let by the builder or his sidekick, The builder went bankrupt in 2008 & failed to complete many areas he charge the purchasers for. He pays no community fee and still lets the properties which are on communial utilities.

The reason that not all the Spanish taxes are paid for all the apartments. they are not legal as we have no Habitation Certificates.

I have just spoken to 2 families of purchases that live in the uk as I do, the first said tha complex looks like a rubbish dump the second who went over for a holiday in mid December, to find that the squatters in the apartment above had climbed down to the ground floor from the 1st floor and broken into the void window, removed anything that was of value like TV electric good etc. A great thing to find when you go out to Spain for a break.

The Spanish Police in the Village came to see what had happened but could do nothing as the goods stolen were not on the premises, foot prints on the wall and in the yard were not proof that these squatters were guilty. 

These squatters are using the community utilities and pay nothing, we are not able to disconnect the utilities because the squatters have children. lots of damage have been done to our lovely complex of 50 apartments and nothing can be done.

The squatters must have broken into the apartments they are living as all were secure in the Summer 2012. 

Spanish residents have moved out as they fear the antics of the squatters.

What can be done to protect our spanish homes when the police are not able to protect our property.

 Being one of the thousands of non Spanish purchasers of a holiday or residential home. I feel that the Spanish Government should take hold of the time wasting departments that take so long to sort the many many problems Non Nationals have when needing to obtain a Habitation Certificate on a property to be able to allow the Utility Companies to install the utility the individual meters, Purchased 7 years ago, an apartment in a block of 50, 14 apartments sold to private purchasers, 3 of which are Nationals. 

7 years on we have no individual meters, the local government are still passing the buck and moving the gateposts when our community Adminstrator's do all the research to allow even the road to be built. The frustrations of those who have paid in full for there apartment or have a morgage, Pay the Spanish taxes, Local & Sumo. 

For the last year the Bank how owns 15 of the apartments & The builder ceased traiding, leaving many areas of the complex unfinished, he owns16 apartments & owes thousands in community fees. Collects rent for many of his apartments from undesirables who use the utilities at the expence of the community purse. The community fees are now €100 a month, the non resident owners pay this monthly.

The Community Purse is paying most of the monthly fees collected to the utility companies, which has now wittered away the community purse. The undesirables are all living free of utility costs, The non nationals are being robbed by these actions and are unable to do anthing about it as the local police say without the Habitation Certificate and the children undesirables children. they can do nothing.

Its hard to beleive that the police hold no power to move on those, who say thay have a rent book from the Builder yet pay no community fees. RED TAPE.   The Spanish Government allow this situation to continue at the expence of the purchasers who spent all their savings on what was supposed to be a Dream Home in Spain.

There are two other UK families that were unable to complete their purchase 6 years ago, the Builder still holds 3/4 of the purchase price, their solicitors are unable to do anything about it, Lives on hold until something is done to help. Wake up Spain.
