Hi, yes.  Good to hear from somebody .........

Have you heard what the status is with the new Developer?  As far as I am aware, no new Contract has been received from FM Consulting.  

The last I heard from FM was that Completion would be October 2009, not 4th quarter of 2008 what they are advertising.

Looks like we are at a loss with the proposed purchase price!!

Hi there, We have an apartment at Cortijo del Mar. We had paid the first 10% deposit last year and the second installment was due on 4th of August. We didn't pay it as we decided to pull out of the purchase when Grupo Labaro went bust. Our solicitor (lawyers from Spain) originally told us that we would be able to execute our bank guarantee to get our money back but we have just received an email from them to say that we are in breach of contract. They say that in order to get the money back we must transfer the second 10% installment of 36,000 euros to their account and they will give it to the notary to prove that we intend to honour the contract. She says that in this way we can then legitimately cancel the contract and get all the money back. It all sounds a bit fishy to me - has anyone else had a similar experience? Would appreciate any input. skc247

Hi 

   If the development is delayed they are in arrears with you so if you do not want to pay the 10% to them you will have to revoke the contract because of delays and ask your money back.

Hi, All,  

The good news is that I went to visit Cortijo in September and all buildings are on their way up.  I am told that there should be a built show apt. on site soon, where you can view all the materials being used.  

My lawyer informs me of the following:-

- That they bought the complex by means of title deed signed on the 19th March 2008 before the Notary public of Madrid Mr. Francisco Javier Vigil de Quiñones Parga under his protocol number 1050.
- That the referred purchase and sale title deed in favour of FM Consulting Turístico S.L. has been duly registered at the land Registry number 2 of Estepona on the 14th April 2008. Therefore the owner of the property that you are buying is now FM Consulting Turístico S.L. instead than Grupo Labaro Inmobiliario S.A.
- The new developer undertakes to complete the property that you are buying.

Apart from this, no contract still has not been received.  We still do not know where we stand, tho having paid the 10% deposit and there is no actual confirmation who is holding the deposit having paid it to Grupo Labaro in the first place.

Hi everyone,

 

I cant say how glad I am that I have found this forum.   My husband and I put our first deposit down on Nov .2005  and then January, 2006 for our apt. on Cortijo del Mar, but as you know it has been horrendous.   We have not been getting any help, and frankly dont know who to trust, regarding the property.   We were told we had a bank guarantee and therefore everything was perfectly safe no matter what.   Due to lack of information, credit crunch, delays everything we are sick of it.   Can you tell me if anyone knows anything about it, and is anyone in the same position ?  Does anyone know how or if we can get our deposits back?   My husband and I went over last year April, we asked Andalucian Dream Homes to view, as it was through them that we bought but, found that some of their offices had closed down and the girl which eventually took us to Cortijo did,nt know anything of this complex.  No information has us very very nervous.  Please if anyone can help we would so love to hear from you

Dear Pattison 1951,

Yes, I agree, in our circumstances, this is a great site. 

My lawyer in Spain has continuously tried contacting Senor Arturo Perez, FM Consulting's lawyer, to no avail.  He doesn't return his tel. calls or e-mails.  He tells me that if we pulled out of the deal, if we were lucky we would get a small amount returned from our deposit. 

What I don't understand is that we haven't received a new contract from these new developers or any confirmation for that matter. 

Also, the new developer, FM Consulting, doesn't seem to be able to take on the fact that we are in a worldwide recession and they're prices need to be reduced for their properties to be sold.   Obviously, since placing our deposit, prices have reduced in Spain, which they can't seem to get their heads round.  How do you feel about the price you are now paying?  I feel they are now over and above what they are worth.  I see that there is a new development being built in Benalmadena and they have reduced their prices by 45%!

If it is any assurance, when I have visited the site, the sales girls are very confident that everything is going ahead.  I visited the site last month and it is in an advanced stage.  One block of apts., which I viewed, even has the water in the pool and they are landscaping the garden.  It appears that when the properties are built, you will have to wait approx. six months for them to be able to get a licence and your deeds before you can complete.  It all depends on when your property will have finished being built. 

The person to contact is Maria Cuevas at maria.cuevasatfmconsultingstopes  Am afraid this message service will not allow me to give you her email address.   She should be able to provide you with whatever information you need.  I normally telephone the site directly and speak to either Yolanda or Stella, who are very helpful, and make an appt. for viewing.  There has been no problem in that respect.  My agent, too, has gone off the scene!

HI everyone,

 

Just wondered if anyone has any further information on "Cortijo del Mar".    We are at our wits end, no info from builders,lawyers,agents, no-one.   If anyone is wishing to withdraw from their purchase as we do, has anyone got any info.    Who is holding our money.   And yes we agree during this climate the apts. are too expensive has anyone even heard if there is a possibility of prices being slashed as others are doing.  If anyone knows anything please let me know.

Hi,

Just thought i would drop a line to see if anyone has any information regarding Cortijo del mar.   As  we are all aware the builders went into liquiation and completion date delayed, i speak for myself when i say we were told completion 2008 (July) for our block , but are very very dissatisfied with agents,builders, lawyers are we are recieving absolutely no information, can you tell me if anyone is in the same situation.   If you have any advise please, please get in touch.

Dear All,

i have just returned from Marbella yesterday and went to have a look at the development cortijo del mar. I must say they have done a fantastic job of it amd it looks just as good as it does in them glossy brochures they produced. However only 30% of teh development has been sold so over 150 appartments are yet to be sold. Can anyone advise of prices they have paid for their properties?

Hi

Yes we bought at the very beginning of the developement going on sale.    That was the end of 2005 and cost for a 2 bed 2 bath was 340,000 euros.  hope this helps.
