 I have bought at Torrequebrada off Aifos paid deposit on 05/06/03 add keys on  aprox 14/05/06 we have court case going on against AIFOS . THEY LEFT THE site WITHOUT FULLFILMENT OF THE CONTRACT NO PAINTING WAS DONE SWIMMING POOL; NOT FINISHED AND SHOULD HAVE BEEN 2 POOLS BUT ONLY 1 PUT IN .I HAVE OLSO BOUGHT AT CORTIJO DE TORREBLANCA

Hello,

 I have just registered on this website/forum and I like so many of you  I want to obtain a refund on my initial deposit, I have been advised by 'Lawbirds' that it may be a good idea to find two other people in the same situation to take a 'class action' against AIFOS.

Has anyone formed such a group and need another member or would someone like to join me?

I thought I was the only one is this situation!!!!!!!!!!!

 For me and 4 friends who olso bought we are going to see it to the end we have done it b4

and done ok the Apt  i have  over doubled in price

Hi all,

         More bad news , we are selling one of the 2 apt ., we bought ,when we purchased the apt.,
         Aifos told us that the kitchen would be fully fitted ie cooker and washing machine but no fridge,
         we were also given a spec sheet describing all the the finish in the apt,on the sheet it says in,
         black and white =kitchen Fully fitted.
         we have a spanish couple interested in buying ,at the weekend they called in the Aifos office ,
         to find out exactly what was in the kitchen ,they were told that the kitchen did not come with any,
         white goods at all, but Aifos told them they could supply these for 3000 euros.
         I will be ringing Aifos first thing in the morning to see what they are up to.
         Dick turpin was a thief but at least he had the decency to wear a mask.

Hi Jim, how did you manage to get anyone interested in buying? Are they just going to take over your contract because as I understand it Aifos are the owners of all the properties until such time as purchasers hand over the final payments. It's a strategy that I hadn't considered.

  Hi Rob,

                      I have had my apt advertised for the last 12 months with an estate agent in fuengirola,
                      When we bought the apts we were told by Aifos that we could sell before completion,
                      I presume the new buyers will just take over the contract ,but the way Aifos conduct ,
                     buisiness there are bound to be problems when we sell.
                     Aifos must be the worst company to deal with in spain.
                     What s really annoyed me is the fact that when we bought the apts,they told us the,
                      kitchen would come fully fitted with cooker and washing machine ,now they are ,
                        saying it will only include sink and boiler,they are trying to get people to purchase ,
                      the cooker and washing machine from them for 3000 euros,which I have been told ,
                     is double the going rate.
                     I can see some real problems coming when this site is eventually finished ,
                     You can t believe a word Aifos say.
                      And anybody who exchanges contracts with Aifos before the habitacion license is,
                     crazy ,because once you have signed you wont see aifos for dust ,they can t be trusted.                             regards   jim

Obviously this Spanish couple are aware of the problems that Aifos have with the development which is mirrored in dozens more of their developments elsewhere. Perhaps the Spanish just accept this nonsense as par for the course and are quite happy to wait and see what happens eventually. Can't see us being able to sell ours though because they have dozens of top floor apartments still to sell.

They refused to give us a bank guarantee and given the situation with the development, and Aifos, I don't think that we have any other option than to sue for return of deposits. If we had a guarantee we would wait another two or three years but without it it is a very precarious situation and I am extremely concerned about Aifos' ability to remain solvent. If you look at the Activa homes website (Aifos under a new name) many developments which previously appeared on the Aifos website have disappeared. Word has it that Aifos have abandoned those developments completely and now there are only about twenty which are still, supposedly, under construction. However, as we know from Cortijo, nothing has happened there for over a year and Fuengirola town hall will make them wait before any habitation licences are issued, if that ever happens.

It's a nightmare.
