I am sorry for my lack of politeness however the jubilant tone of Alan and Debs post amidst my misery.despair, concern ,frustration and worry was more than I could bear.I am delighted they have finally got thier dream home  however I cant help worrying that without habitation certificates,the build still being illegal and the new issue of sewage seeping from the site to the salt lakes and surrounding area that there is not that much to celebrate.I am not surprised that San Jose dealt with the snagging list and completion with such satisfaction they were probably delighted to get another one of thier hands  ( it is my understanding from my Lawyers that after completion the owner of the property takes on the legal responsibility for any problems with the council/courts etc ) My lawyer is strongly advising us to pull out of the property we signed up for in 2004 .We have paid arond 2/3rds of the total cost so far but are told by our lawyers the only chance of getting our money back is to use the "failure to complete" clause in the contract. (others have tried this and  been awarded full refund and court costs and still San Jose have not paid) One of my biggest fears is  that somehow  San Jose managed to finsh our apartment and we were forced to complete with none of the problems resolved. 

I have waited so long because I fell in love with the area and also because San Jose seemed like a reputable very large company and I presumed the problems at el pinet were just a blip in a usually scrupulous outfit however I have heard recently that another two of thier sitest are hitting similair problems.

The AHAS  environmental group have no intention of stopping these court cases and are quoted as wanting a total demolition of the site. I hope this could not happen but the serious breach around the seeping of sewerage gives power to their elbow and Iam shocked that San Jose seems to have done nothing to rectify this issue.I cant help  worrying that in the face of all of this San Jose will throw in the towel and walk away .

Once again may I apologise publicly  for my  "plonker " comment  it was unfair as no one is really sure what to do for the best . In my defence may I say that I am usually polite however my heart is breaking with all of this and I dont know what to do

Hi Everyone

im new to this site i have an appartment i was one of the 1st to move in on this development im currenltly in the process of purchasing a house on the same development does anyone have any up to date news as i have not been out since august, and im unsure as to go ahead with the second purchase.

I don't bother to check on the forums very often as they depress me no end. I bought at El Pinet off plan in June 03 and am still waiting, in all that time I've recieved 3 pieces of correspondence regarding delays. I tried unsucessfully to get my money back through breach of contract but was told there is no breach, via a UK Solicitor. I cannot believe this latest info that has been raised by Garcia, has anything been resolved since to anyones knowledge? My agent is as much use as an ashtray on a motorbike and I am now so over this whole experience I try to pretend that it doesn't even exist anymore but the fact I invested every penny I had at that time and borrowed from family and friends to pay my deposit and have seen nothing is gutting.  Has anyone heard anything more?

Hi there, I am an estate agent who lives and works in La Marina. I am still owed monies by San Jose as my clients (all 3) could not complete on their houses due to the fact that the banks pulled the mortgages away from this site. They have recently closed the camping site with orders to demolise it. The surrounding area El Pinet looks more like a bomb site and we never take clients down to the wonderful beach through this entrance. Its a disgrace on the then acting office in Elche, and San Jose who new all along that this development would NEVER be complete. The roads in and around the site are a nightmare to drive on. La Marina will be developed over the next 3-5 years and I hope that the building here will encourage the NEW develper who takes over the site to finish this off.

Thank you for this even more depressing news.....I'm heading over next week and am going to look at my options while there. Its so sad as El Pinet could be the most fabulous area if everyone worked together for the best end result rather than half promises, finger pointing and sheer pig headedness. I live in Dubai at the moment and they throw building up here in months the whole country is a building site but we know it'll all be finished in a matter of years.  I guess only time will tell but its really not helping Spains reputation at the moment.  Thank you for replying I do appreciate it. I'll let you know how my visit goes!

We heard on Saturday the 21st Feb, That Bankinter have given a mortgage to someone who has purchased on El Pinet. This is Fantastic news. It seems  that Bank Santander have an interest on the site. It has also come to light that San Jose have been paying Elche the Suma Bills it recieves on El Pinet, so if the government are accepting this then one should have a green light.

I have bought and paid for my apartment 21/2 years ago and I have not paid a euro for any suma. So I dont know were San Jose are getting monies to pay Elche. Since paying for the apartment I have only heard from San Jose once!!!! Good customer relations.......... take your money and run................ We are not supose to use it........ cant sell it........ no certificate of habitation.....a pig in a poke........

Simply amazing it can get to this stage with no one taking ownership of the situation, we are flying to spain in a few days to see if there is any current solution to our case but I doubt it very much,

I agree that it is so frustrating, particularly the lack of information and really not knowing who or what to believe.   I have found some "helpful" links to documents relating to the problems at El Pinet on the Costa Blanca Forums website.  Under the El Pinet section,  if you look at the link entitled "who knows what at El Pinet" and scroll down this link to dieciocho's entry dated 7th August 2007, there are 3 or 4 links to websites which have El Pinet related information.   I then cut and paste these pages into the Babel Fish translation website and translate it from Spanish to English.   As one would expect, the translation is terrible but at least you get the gist of what is being said.   It doesn't solve any of our problems but at least I have more of an idea now of what the basic problem is.   I hope this might be useful to you.   I will post any more information I come across on this Eye on Spain site.

We are just back from another trip to El Pinet, its in the same situation as last time other than the roads having changed and it looks like the campsite is slowly vacating but could've been low season not bringing in the crowds.  Nothing elsse to report so as ever keep us posted if anyone hears anything!

Hi All there is a lot of new info on a website called fiestasiesta about El Pinet.Some residents from El Pinet have been in touch with a jounalist from Roundtown news and she has been trying to get info she has posted a reply (yesterday from San Jose) and is writing an article in the paper ,this weeks edition which is due out today .Hope this helps its worth reading the thread "whats happening in El Pinet " heres hoping for some good news at last ******

On a visit last week, a resident told me that Eva stated that the court case had been won in Valencia, and that the Judge was preparing the paperwork for San Jose to collect, within the next month or two. Work to finish the site could then start. Who knows ??
