 Would any person who purchased Sea& Sun Hills Selwo Estepona or any other development which involved Bluestorm S.L.the developers who were involved in operation white whale contact me through  E.O.S.

My understanding is that they are in financial difficulty, therefore it is most unlikely that any refunds will be issued.

 At this stage i am in contact with Maria of Costaluz Lawyers who is willing to represent persons who wish to pursue the Banks for our refunds.Obviously there are no guarantees although at this moment in time we have no other alternatives.

I am assisting a good friend of mine in trying to get his sizeable $$ deposit back from the Sea & Sun Hills development in Estepona that involved Andalusian Jurists (lawyers), DVA (Del Valle) Abogados, Ocean Estates., Aureus and Bluestorm etc.

I am not sure your problem relates to the same block/development as you but in any event would like to speak with you so we can exchange information.

We shall be in Cost Del Sol 12 - 14 September - arriving Sunday 12 @ 12.00 CET and departing Tuesday 14 @ 18.00 CET.  I also confirm we have instructed a good legal firm in Marbella (Plaza Abogados S.L. - Mr Carlos Llanos) to act.

If you could communicate in the first instance via telephone (+44 7712-599646) that would appreciated.

 I have recently spoken to an independent lawyer re. my deposit on an apartment in Sea and Sun Hills, Estepona. His advice was to hook up with other owners and put pressure on the developer to grant significant price reductions to encourage completions. He rates our chances of refunded deposits as nill - even if a court case achieves a successful outcome, the developers have no money and would simply declare bankruptcy, putting property owners well down the list of creditors.

He also advised against court action against lawyers for negligence etc. as this could get tied up in the legal system for years.

He strongly advised against signing any new documentation with the developer (as has been requested in my case) as this could force immediate completions. 

His best advice was to wait it out - hope for a better exchange rate or a bigger price reduction and then go to completion - at least then you will have something to show for your original investment.

Meanwhile who is responsible for the upkeep of the development - does anyone know?

Hi, Sorry there is no easy solution to this problem, we paid a deposit in Jan. 2003 of 85,000 euros to Direct Lawyers/ Ocean Estates.As you know property values have dropped significantly therefore your advice from your Lawyer whilst seems appropriate i am not sure if this idea sounds as good as it seems. In my opinion they the developers would have to offer 50% off the balance, even at that you may have to wait several years before this investment would break even? Maria from Costaluz Lawyers is willing to represent clients in our situation,she feels there is a good chance to sue the Banks under Law 57/68, again i am not sure if we should proceed as this could incur further costs. We have reservations as to the upkeep of this development as we have not been out for 3-Years. Should you wish to discuss this further please post reply.

Good to hear from you, not too sure if the following info is of much use.

1)S.& SH Block 5 apartment 611

2) Deposits paid to Cajamar, Marbella in 3-lots totalling 85,000 Euros.

3)Costaluz Lawyers have intimated that they will re-access my case bearing in mind the the judge has requested that the Bank to deposit 1.5 Million euros in a holding account which i understand has since been transferred.I will keep you informed)

4)Back in January 2003 our Lawyers were Hasburg McGowan, they in turn sold out to DM lawyer approx. 2004, whilst they moved to new premises my understanding the some of the directors moved onto this new company..

Would you kindly check out .directpropertyinvestments      they appear to be selling our properties for 151,000 euros does that mean with our deposit of 85,000  that we pay 66,000 making a total of 151,000 plus taxes.?
