Hi, 

I have sent numerous e-mails regarding deposits paid against off-plan properties,our development Sea & Sun Hills, Selwo was completed, as the property market collapsed we chose not to complete. . With the recent success with Finca Park we are now seriously considering contacting Maria of Cotaluz Lawyers.

At the moment we have 2-other victims considering similar action,perhaps you maybe interested in joining forces.

Your thoughts would be greatly appreciated.

Deposit of 85,000 Euros paid against Sea & Sun Hills selwo estepona through Ocean estates wh no longer trade, this dates back 2004. At that time the Lawyer was Hasburg McGowan who apprently sold out to Direct Lawyers in 2006. Not sure of the current position. Did contact Costaluz Lawyers who did acknowledge, as yet nothing has happened.

Good to hear from you, not too sure if the following info is of much use.

1)S.& SH Block 5 apartment 611

2) Deposits paid to Cajamar, Marbella in 3-lots totalling 85,000 Euros.

3)Costaluz Lawyers have intimated that they will re-access my case bearing in mind the the judge has requested that the Bank to deposit 1.5 Million euros in a holding account which i understand has since been transferred.I will keep you informed)

4)Back in January 2003 our Lawyers were Hasburg McGowan, they in turn sold out to DM lawyer approx. 2004, whilst they moved to new premises my understanding the some of the directors moved onto this new company..

Would you kindly check out .directpropertyinvestments      they appear to be selling our properties for 151,000 euros does that mean with our deposit of 85,000  that we pay 66,000 making a total of 151,000 plus taxes.?

 Hi,

 

I am currently involved with the following development;

 

Sea & Sun Hills,Sellwo, Estepona.Nos. of apartments 59  Nos of which 10 occupied

 

Development commenced: Jan.2003 and completion December 2004 which did not happen.

 

Average price paid: 300,000

 

Average deposit paid: 100,000 x 49 = 4,900,000.00 lost to developer Blue Storm in adminstration

 

No Bank Gaurantees' Estate Agent            Ocean Estates; Gone bust? 

 

To add insult to injury the lawyer representing ourselves( Hasburg McGowan) sold out to a company who are currently our lawyers Direct Lawyers; had the cheek to take their fees 4,200 euros when they sold out for a property that we never completed on.

 

 This could only happen in Spain.

Hi, Sorry there is no easy solution to this problem, we paid a deposit in Jan. 2003 of 85,000 euros to Direct Lawyers/ Ocean Estates.As you know property values have dropped significantly therefore your advice from your Lawyer whilst seems appropriate i am not sure if this idea sounds as good as it seems. In my opinion they the developers would have to offer 50% off the balance, even at that you may have to wait several years before this investment would break even? Maria from Costaluz Lawyers is willing to represent clients in our situation,she feels there is a good chance to sue the Banks under Law 57/68, again i am not sure if we should proceed as this could incur further costs. We have reservations as to the upkeep of this development as we have not been out for 3-Years. Should you wish to discuss this further please post reply.
