Just to let you know that we have cancelled our contract and have now received all our deposit back with some interest.We 'bought' in Feb 05 on ph1, block7,portal24, ground floor,end. As we watched it develop on our many visits we were pleased by the layout and location of the development and particularly by the position of our apartment. We saw inside the apartment in Oct 06 and it was completely finished and to a high standard.
Four years is a long time. Too long. My wife's illness 12 months ago (she continues to do well) and the changing economic climate made us finally decide to cancel. We instructed our solicitors whilst in Spain at the end of Oct 08 and received all our money back, with some interest, yesterday. Our solicitors were keen that we should sue the developers for costs but we decided to pay these ourselves and take the insurance money. As we paid in at about 1.45 E/£ and exited at 1.12 the costs were covered.
Thanks to pdrich1 for suppling a copy of the Licence of First Occupation but in the end it was not enough. We still think the development will be fantastic and the good (though not silly) times will return. Duquesa is a great holiday destination and we are out there at the end of Feb to close our Spanish bank account and get our fix of the Mexican and a few beers and coffees in the Oasis and Dolphin.
