Hi all who have not received what they are paying/paid for.

Polaris World Pressure Group

I have suggested this many months ago and more recently TimA and others have made similar suggestions, I like others have been battling away on my own to have PW provide what they agreed to provide to me in my Contract and also the promises made verbally by the sales staff and in line with the promotional materials they produced.

PW are having no trouble giving me the run-around saying sorry but doing nothing and professing the majority of others are happy with everything. They also know I am unlikely to make a legal challenge to them on my own as I would be unlikely afford the cost on my own. There game is simple keep us isolated.

The only way we can stand any chance of making them provide all the things they originally agreed to supply or provide compensation for not, is to group together and form a pressure group and if necessary as a group fund legal action. The cost of legal action can be established and a limit set, with a reasonable sized group it would probably be an amount of money worth paying for possible success. Don’t get me wrong I am not suggesting we start getting bitter and twisted about this just organise spared the cost and mount a serious challenge to them David can defeat Goliath.

It only takes a small group to act as a comity and enough members to spared the cost so it doesn’t have to hurt if we fail, which I don’t think would happen but hay no guarantees.

Hi Nick

For me personally

  • Air conditioning: Our signed contract states Pre Installed making the full system part of the contract and NOT as Polaris World now say Pre Installation
  • Pergola: Is not as agreed in our signed contract and no explanation given to us has justified the change.
  • Town Centres: were part of the original project and are now not being provided removing facility and services from us.
  • Shutters: we were told by sales staff we would have them on all doors and windows.

Phil,

On the air-con - have you checked your Spanish language contract? It may be the English translation, and that is not the one that matters.  My understanding, and I think generally in Spain, it is pre-installation.

Hi Ted

Thanks for your suggestion; all my singed contract is in both Spanish and English and you are correct that only the Spanish interpretation is relevant, except for the specifications which were only in English in my contract so the English interpretation is the only one available in the contract.

However this post isn’t intended to be about my personal circumstances, it’s to see if others with similar but not necessarily the same circumstances are interested in forming a pressure group.

With regards to the air con we were told that all the pipework would be pre-installed but you would then have to buy the actual units. The printed list of what you get with your apartment is ambiguous though because it says air conditioning is pre-installed. Customers may take that to mean the units aswell but Polaris have different ideas. 

A bit off topic but do we get a shower pre-installed in the bathroom or do you have to buy that?

Ooch - yes there is a shower (a fitting in the bath) - but not curtain or screen

Sorry, realise this is a serious post and didn't mean to take it off the main topic. I am happy with my purchase, but wish you all the best in your efforts, and hope you manage to pull together a few other in similar situations.

I am sorry to say if early completion were your only issue you would have no real chance of any success as you contract allows for earlier completion.

PGM - My contract is exactly the same - air con pre-installed.  I think there is a difference here between Jardines apartments which say pre-installation and Jardines at Naranjos which say pre-installed.

I'd be happy to press this point - not completed yet so dont know what else I have to raise.
