In may 2004 we paid a deposit on a duplex and two more payments totaling 76000 euros. We never get any update of what is happenig on this development from any source .Our solicitor  cant get  any information  .This development should have been completed in june 2007,but seems they haven;t got permissions in place yet. Hi, i am in the same situation with the ingofersa development.i've been looking on a spanish forum gurrucha.net about the development. it is hard to know what is happening between the town hall and ingofersa about the approvement of planning permission. i don't know if you have requested a refund yet or are incontact with other people who have bought off plan with this company. i know that off plan developments, the deposits of the clients are suppose to protected with bankers guarantees. but i don't think ingofersa have this. i live in london and it's difficult to find out what to do,  hope everything will turn out good eventually.  it would be good to hear from you to find out more, Eddie

Hi, I am in the same situation.  I entered into buying one of these villas in 2003 and invested 70,000 euros.  I have got a court case pending with Ingofersa at the moment who have refused to refund my money voluntarily so they will have a court order made on them to auction off their assets to pay the money back.  Is anyone else in this situation.  To me it amounts to pure theft.

HI, I HAVEN'T  HAD  NO MORE INFORMATION FROM INGOFERSA FOR SOME TIME. I HOPE TO BE GOING OUT TO VERA IN ABOUT 2 WEEKS TO FIND OUT WHAT IS HAPPENING AND WHAT MY OPTIONS ARE. I HAVE NOT BEEN TOO IMPRESSED WITH MY LAWYERS WHO ARE IN VERA ALSO.SO I SHALL WHAT THEY HAVE TO SAY, IF YOU KNOW OF ANY INFO RELEVENT, OR INFO TO ASK LET ME KNOW, GOOD LUCK ! STEDDIE

Hi Again, Yes please let me know how you get on.  Which lawyers were you using was it AG Accessors, if it was, I was using them but the people in the office dealing with it kept leaving so I swent with someone else who broke away from them.  It has cost me about £6000 in solicitors and court fes so far.  Im sure they are going to try and get out of paying the money back.  In fact, i think they've spent it.  Im sure they are never going to be built.   Good Luck!!!!!!

We have paid over 50,000 to Ingofersa and have received in return many sleepless nights!  At first when we heard that things were to be delayed we decided to stick with it.  However last September we met with Ingofersa and they offerred us alternative apartments.  We decided on las molinas and they told us they would be in touch when they were ready for us to officially sign for them.  To our dismay they have emailed us and informed us they had made a mistake and sold this particular apartment to someone else.  We went to our Solicitors AG who are trying to sort it out.  Honestly I am at     my wits end. Please let me know if you can find anything out.

I have paid out about £9000 in legal fees so far trying to get my money back.  I took the case away from AG because the people dealing with it kept leaving and it kept going to the bottom of the workload.  As far as I an tell my situation now is that Ingoferssa have ben issued with a court order to freeze their assets which will have to be auctioned off to pay back they money they owe people.  The ones that have taken it to solicitors anyway.  The whole process is so slow.  I dont think Ingofersa have any money, any cheques they have sent people have bounced.  I think they are a load of crooks and are probably somewhere in South America now.  A lot of people are in this situation and there seems to be nothing more we can do about it.  I dont think for one minute the developement with be built now.  I just wonder how much more money I have to throw away for what seems no results.  Thats my opinion anyway.  Its just so much money to forget about.

I went out to Almeria  2 months ago to view some properties that ingofersa had offered me instead of burganvillas. I didn't like the 2 they showed me. so i'm now in the process of trying to get my money back, which my lawyer told me could take up to 2 years. ingofersa still have an office in vera and another in Garrucha, and they are building apartments in Gurrucha (although not on the scale of Burganvillas) i did met with Angel Ferdanez. so i am hoping that i will get my money  in the end.

Its difficult to know what to do for the best isn't it - wait and hope for the best, or take legal action, spend more money (that we haven't got) and possibly force Ingofersa into liquidation, which would mean no chance of recouping anything? Advice is mixed. Back in 2006 when Ingofersa offered a refund, a delay or alternative property we chose the refund and have a signed revocation from Ingofersa. The terms of this 'contract'  mean we should have been repaid at the end of 2006. Still waiting.........no news ever received.........and surprise, surprise, the UK agents have distanced themselves from the whole sorry affair.

We were considering a visit to Garrucha - but don't know what this might achieve. All suggestions gratefully received.

 I am not sure how many people are effected by this! I am in the same boat as many, pretty sure that I haven’t invested quite as much as some, but still an amount that I would want to fight for!

I would like to know how we can get our money back and have been informed that Maria de Castro may be able to give some information on how we can do this!

I can’t believe in this day and age, that there is this amount of corruption going on!

I know of about eight people sho are in the same situation.  Some prople think that they will be built still.  I have spend about £9,000 on legal fees so far and have been trying to get my money back for two and a half years now.  Did you buy through European Village agency because I think they should be doing more to help us as they took our initial deposits, but they dont want to know either.  What I cant believe is that they are still building and selling property  apparantly.    We should form a sindicate and then put to case to some Spanish watchdog or television programme.   Any suggestions.

 I went through Town and Country South West, who I believe went through European Village. A guy called Angel, who was mentioned below, was mentioned to me by Town and Country, they said that he could maybe switch me over to another development! Don’t think so! Just want my money back. I have tried a solicitor in Spain for a time, but that wasn’t very successful.

 

I think the person who could help us is Maria de Castro, or certainly give us some advice. 

Obviously with the credit crunch hitting the UK, money is pretty tight for most of us! The sooner we can get something moving the better! I think we have been pretty patient so far!

I  think we've been more than patient!  And like others here we just want want whats rightfully ours - our hard earned money. 

We too went through EVA (who have never been great) and Town & Country. We were told at the time that this was such a fantastic development that many of the T&C staff had also bought into it. We've been in constant contact with T&C since 2006 but are constantly fobbed off. If so many of their people are involved in this development you'd think they'd know more and perhaps care more.

We have used a local solicitor (with a Spanish speaking solicitor) to wrote on our behalf, with no response. We've even tried a Burofax without any luck. It got to the point where this solicitor advised us they could do very little more for us unless we wanted to spend serious money and were prepared for a fight that would take many years.

I RECENTLY SENT MY LAWYER IN SPAIN MORE MONEY, SHE INFORM ME IT COULD TAKE ABOUT 2 YEARS TO GET MY MONEY BACK. I HAVEN'T HEARD NO NEW INFO, SO I'LL JUST HAVE TO PROGRESS ALONG THIS ROUTE AS IT SEEM THE ONLY WAY FORWARD

I have switched to an alternative property even though I don't really want it. I am trying to safeguard my money... whether it works or not who knows. Some people say the whole thing will be resolved this year as Ingofersa is getting money from some of the other developments that have been built.

I hope everyone gets their money back. But this Buganvilla IV development is never going to happen. The developer allegedly had so much stress with the town hall trying to extort money from him all the time, that he is fed up and won't go ahead.

Either switch property or wait top get your money back. Fingers crossed this year..

Hey Puneet !

Not sure if this really means anything given Angels past, but he has apparently admitted to the court that he owes us money. We understand from AG2 that this means he has a set time period to pay the court our money.

If ths actually results in anything i will posback onto this thread.

Nice to hear from you. Good news.. i hope it is all resolved soon. i don't think Angel has deliberately done any of this to be honest... i know he wrongly used our money to fund other developments, but he has never denied owing any of us money.. it's just that we have to wait until he transfers deeds of these new properties over to people who have bought his completed properties and then can finally pay us back...

I have been talking to a chap called Steve who lives in Spain and he goes to the office all the time... he tries to update people as best he can. If he hears anything, I will let you know.
