Dear buyer,

As you can check in the second page of this web (Spanish Official Bulletin, BOE):

the promoter Cogilcodos (i.e. Las Mimosas, Benalmádena, where I have two clients) has issued its claim of bankrupcty, which was declared last June (12th).

I do recommend you to get legal advise about this matter immediately, given that Palmera Properties is out of the scene and the consequences of not being part of the bankrupcty procedure in time would be unchangeable and serious for you.

I own a las mimosa, how will this effect me now?  my lawyers have not told me this information at all.

Dear buyers from Cogilco:
 
I can confirm you Cogilgo´s insolvency proceeding was opened last mont, with a warning in the Spanish Bulletin (dated in 5th July). The only way know about that proceeding and try to get your rights from it is being party in it. For this management you need to communicate immediately (within the period of 30 days from 5th July) to the Court your situation (giving  all your original paperwork to the Judge) and being represented by a lawyer (like myself) and procurador (a kind of solicitor who receives and sends communications from and to the Court, obligatory according to Spanish Law).
 
I do recommend you to make all the necessary managements in order to be party in the insolvency proceeding and get information of every new in the case. You will be able to deal with Cogilco´s insolvency administrators and be one of the creditors whose rights must be considered. 

I must highligh you have to move fast if you do not want to lose your opportunity of being in the insolvency proceeding and trying to protect your rights.

Hi All at Las MIMOSA

    We are Barry & Sue from Newcastle.

    We are in the process of buying a penthouse in Las Mimosa. We have gone through the process of trying to get our deposit back

  since Sept 2007. We were originaly offered 50% refund which we accepted, then we were told the developer could not pay due to

   cash flow. We are using a lawyer in Feringurola but things are moving very slow (even more so because of the court situation)

   I belive the value of the properties have gone up slightly since deposit paid in 2004 but with the devaluation of the £ against the euro
   it  increases the price of a penthouse by 20,000 euro.

  We have not viewed the development since last year, are there many properties occupied ?

 What is the situation with the water supply?

 Should the court not instruct the developer to solve the water situation as it must be breach of contract.

Any info  or coments about Las Mimosa would be appreciated.

If all concerned got together we would be in a stronger position.
