If selling a property in Spain, and have been offered a price less than you purchased it for,do you still have to pay 3% tax on completion? If so how long to get it back? and how will it be given back? Could it be months?

Hi JANITA,
I take it you are talking about the 3% retention that is taken at notary on the sale of a property,this is to make sure that there are no outstanding debt against the property ie unpaid bills.
You will get it back but again it can take months.
You will not pay this if you have residencia,unfortunately there is no nipping down to the town hall to get your residencia just to avoid it,you have to have held resident status for at least a year.
Unfoirtunately as far as i am aware it makes no differnce if you are selling at a loss,you will still have to pay it as it will be deducted at source.
