Hi
Hoping someone can give me some advice.September 2004 my late husband invested unwisely in two offplan properties that were due to be completed Feb 2006 and still have not been. He died unexpectedly last year leaving me in a difficult financial situation. His Spanish solicitor has told me that the developers are not obligated to change the contracts to my name unless I complete the inheritance process and pay the tax. They will however if I allow them to change the completion date which would prevent me taking legal action against them to dispute the contract. This solicitor is against legal action but as I have now discovered he failed to obtain a bank guarantee  so I am not sure I trust him.

Hi,

If the development is still not complete then you have grounds to cancel the contract andd a good solicitor would give you the best advice on how to deal with the inheritance tax aspect.
