When I bought a property in El Soto de Marbella to sell on "off plan" I was assured that it had an assignable contract. I have been contacted by the person that bought it from me saying that the developer wont hand over the contract as there is a clause in my original contract which forbids me from selling. I am waiting for my solicitor to get back to me. Any thoughts??

It all boils down to what you have in writing and what you were "Assured" of
Anyway if you've got your money, and i presume lawyers and such like were involved, its not your problem anymore

I agree. Developers are being awkward under current circomstances and it may be beaceuse recently the law changed to ensure anyone selling an assignable contract would still be liable for transfer tax!
Hold your guns as if you are out of the contract and have your money - and I am assuming you did sign it over with at least some written contract between you and the new buyer - then it is down to the lawyers to sort out!
