Dear Sr. Rajoy

 

Congratulations on becoming the new Spanish President.

 

Our website and petition - www.bankguaranteesinspain.com - is representing all those innocent people who attempted to purchase an off-plan property in your wonderful country.

Unfortunately due to the lack of supervision by the Banco de España and the systemic corruption in the Property and Banking Sectors we are now victims of Bank Guarantee Abuse.

 

Our off-plan deposits have been stolen by the corrupt developers and negligent Banks.  LEY 57/1968 has not been enforced and the Banco de España has failed in its role as the SUPERVISOR OF THE SPANISH BANKING SYSTEM.

 

Your court system is overloaded and cannot deal with the number of cases.  On many occasions Judges are failing to apply LEY 57/68 correctly in their judgements.

 

LEY 57/68 was introduced in 1968 to protect the purchaser from the abuses and corruption in the property sector.  The rights granted to us by LEY 57/68 are 'Caracter de irrenunciables'.  Our rights have been violated.

In your 100 Proposals for Change you make several references to transparency, trustworthiness, credibility and consistent justice.  For example:

 

"A modern state must guarantee values of certainty, legal security and legal trust"

 

"rigorous tackling of many of the problems which have so far been ignored"

 

"We must restore our trustworthiness and credibility in the world"

 

"greater answerability backed up by full transparency"

 

Your document concludes by stating:

 

"We must recover our leading role abroad as a reliable, dependable and respected partner. The economic and institutional reforms we are going to undertake will contribute to international respect for Spain and its international role as an advanced Western democracy that is committed to freedom, democracy and the defence of human rights"

 

To achieve this you must immediately tackle Off-Plan Bank Guarantee Abuse and ensure LEY 57/1968 is enforced in all cases – past, present and future.

 

During the past year we have been in contact with the advisors of the former Housing Minister - Sra. Beatriz Corredor.

 

We look forward to working with your Housing Minister, Minister for the Treasury and Minister for Economic Affairs and Competitiveness to ensure that Off-Plan Bank Guarantee issues are resolved and measures are put in place so this corruption and abuse can never happen again.

dear keith,

                  Well done and well worded,i hope he gets this and not one of his minons we all must keep pushing in the new year 2012,i put my depoit down in 2003 and won my court case nearly 3 yrs ago,still waiting but do not intend to give up,hope everybody else feels the same.Good luck for 2012 to you and all the rest of our fellow sufferes.

Estimado Sr. Rajoy

Felicidades en su elección como nuevo Presidente del Gobierno español.

Nuestra página  web, así como nuestra  petición - www.bankguaranteesinspain.com -  quiere representar a muchas personas que en su día tuvieron gran ilusión por comprar una vivienda sobre plano en su maravilloso país.

Desafortunadamente, debido a la falta de supervisión por el Banco de España y  a la corrupción sistémica en el sector inmobiliario y bancario  español , estas personas- yo entre ellas- somos víctimas, al no habernos sido entregadas las debidas garantías.

Las cantidades  que entregamos a cuenta  en compraventas sobre plano han sido robadas por promotores corruptos y bancos negligentes. Ha habido un incumplimiento general de la  LEY 57/1968  y el Banco de España ha fracasado en su papel como SUPERVISOR DEL SISTEMA BANCARIO ESPAÑOL.

El sistema judicial español está sobrecargado y no es capaz de asumir el gran número de casos. En muchas ocasiones los jueces no están aplicando correctamente LEY 57/68 en sus  Sentencias.

La LEY 57/68 se introdujo en 1968 para proteger al comprador de los abusos y la corrupción en el sector inmobiliario.

Los derechos que nos concede la  Ley 57/68 son " de carácter irrenunciable” . Nuestros derechos han sido violados.

En sus 100 propuestas de cambio, ustedes hacen varias referencias a la transparencia, la honradez, la credibilidad y la consistencia de la justicia:

"Un Estado moderno debe garantizar los valores de certeza, seguridad  y confianza jurídica"

"La lucha  rigurosa contra muchos de los problemas que hasta ahora han sido ignorados"

"Tenemos que recuperar la confianza y credibilidad del mundo"

"Mayor capacidad de respuesta respaldada por la plena transparencia"

El documento concluye diciendo:

"Debemos recuperar nuestro papel de liderazgo en el extranjero. Que se nos considere un socio fiable, respetado y de confianza . Las reformas económicas e institucionales que vamos a realizar contribuirán al respeto internacional para España y su papel internacional como una democracia occidental y avanzada  que apuesta por la libertad, la democracia y la defensa de los derechos humanos "

Para lograr esto usted debe inmediatamente hacer frente a los abusos que en materia de cantidades entregadas sobre plano se han producido en España y trabajar para que la ley  LEY 57/1968 sea aplicada en todos los casos - pasado, presente y futuro.

Durante el año pasado estuvimos en contacto con los  asesores de la ex ministra de Vivienda - Sra. Beatriz Corredor.

Nos mostramos disponibles para  trabajar con el Ministro de Vivienda, Ministro de Hacienda y Ministro de Economía y Competitividad a fin de garantizar que los problemas en relación con  los Avales Bancarios de la Ley 57/68 se solucionen y se pongan en marcha medidas a fin de que esta corrupción y abuso no se vuelva a repetir.

Rajoy and Cameron scheduled to meet 21 February in London, says Madrid media

Mariano Rajoy, Spain’s Prime Minister, is expected to meet with his British counterpart David Cameron later this month. According to Spanish press reports the meeting is likely to take place in London on February 21.
