Hopefully ALL Roda owners will finally have received an email from Resortalia with regard to the firthcoming Entidad AGM on 15th Feb.
Only 2 weeks notice as required by Spanish Law but not a lot if you wanted to fly over to attend.
There is much information included in the email notification including details on the 6 vacancies that will exist on the Board as original members have to step down after 4 years.
A few are debtors and a small number of members do not attend meetings so currently the board is represented by a very small number of hardworking individuals who are busily correcting many previous mistakes of the board.
It is important, if you wish to have an input that you either attend or nominate someone you know and trust as your proxy to vote on your behalf and support individuals who you wish to see stand for the many board positions.
The Entidad Board controls a budget of 3/4 million euros of owners money so is a powerful tool.
Proxy forms MUST be returned, signed and completed to Resortalia as per the note on the AGM call.
AGMs are called for all owners to have a voice, please use it.

For those of you who do not already know, I have no wish to hide behind Forum names and my name is Chris Perree.
I am the current President of Community P12 which consists of the apartments on Phase 2.
We on P12 are represented by a Committee structure as I personally feel too much power is granted to Presidents under Spanish Community Law.
It is my belief that we on P12 are doing a reasonable job for our owners given problems with debtors etc.

I have been a critic of many members of the Roda Entidad Board over the last four years and I have been admonished for being outspoken. I do however feel, you cannot complain about others if not prepared to make changes yourself. With this in mind, given the fact that 6 Entidad Board members have to step down this year, many due to having served a four year term, I have decided to put my name forward to serve on the Board in the hope that I can work on behalf of all Roda Owners to ensure we all continue to see improvements and value for money at Roda, which under control of the owners NOT the developer.
The current volunteer Board have certainly made a number of improvements despite being reduced in number by lack of support from some members, some of whom like the Roda/Calidona representative who are currently massive debtors.
The Board deserves and needs full support and numbers to spread the load that the size of budget demands.

Should any of you wish, I would be happy to accept your proxies naming Chris Perree as your representative at the forthcoming Entidad AGM. Completed proxy forms need to be returned to Resortalia NOT me, as per their recent Entidad AGM note.

Please pm me if there are particular concerns you would like put to the Entidad Board at the AGM.

Yes, we have received our notification and can't get to the AGM at such short notice either.  We will be sending our proxy as it seems more important than ever this year that owners choose who they wish to take care of the resort on our behalf.  As a matter of interest, I scanned through the list of debtors and it appears that the amount owed by the developer (at just over 49,000 euros according to my calculation) accounts for  more than 10% of the total debt!   The developer has left behind an unfinished resort and a litany of broken promises, now they won't pay the fees needed for Roda's upkeep.

I would also agree with the previous two posts and repeat our appreciation for those who work very hard on both the Entity and Communities on our behalf to do a difficult job for no reward.  P12 is in good hands.

Good luck in the election coming up.

The debtors figure of close to half a million is scary and hopefully the administrators will be able to report on some success with debtor follow up especially with both the UK and Spanish debtors. Our previous community follow up was abyssmal and the debtors figure just kept growing. One wonders how much more debtors an entity or community can continue to support.

There is no doubt that all owners owe a considerable debt to those who have volunteered for work on our behalf in the past and to those who are prepared to take on this work. It is thankless and hopefully those attending the AGM will elect owners who have at least have a good understanding of the language and who have some business experience to offer as these two credentials are essential in our opinion having been members of a Spanish community for over 20 years now. 

As we understand it those who are stepping down can be re-elected again to serve another four years, surely it would make sense to have some people who understand the procedures and how things work to stay on?

We cannot attend unfortunately but are looking forward to some positive feedback on the meeting and our proxy vote has been sent.

I totally agree with all you say which is why I have put myself forward.  I have served as President of another community for two years,  have a pretty good grasp of how the system works in Spain as we had very contentious issues on that resort to deal with (and are still dealing with).

Let's hope a good positive team who are not debtors get elected to fly the flag for all owners on Roda Golf.

It would be really great if the majority of owners took the Time and trouble to respond to the Entudad AGM by giving their proxies. The majority of owners leave everything to a small group of people to keep Roda going.
Please respond to the Agenda sent to you all rather than just ignoring it. It is really important to give your voice to an attendee of the AGM this Saturday.

Unfortunately I can't be at the Entidad AGM as I'm in the UK caring for my mum.

I've given my proxy though and hope that those attending and voting have the sense to elect a good committee. I'm sure there will be much heated discussion as Roda have put themselves forward to be elected as a member of the board once again. They are the biggest single debtor but as they do have some properties that they keep payments up on they are still entitled to stand. Totally wrong in my opinion but that's how Spanish law interprets the byelaws.

You will all have received brief notes from the AGM from Resortalia, including the make up of the new board.
Thanks to all who supported me or sent their proxies in, I had about 40 in total. Unfortunately not enough to keep Nadege Bineau the Roda representative off the Board despite their debts, they apparently were allowed to cast votes for the empty holes in the ground where apartments can be built as they pay reduced fees for these.

Sadly even 40 proxies plus about 40 owners present is still a small representation of 1200 properties onsite.
We will only rid ourselves of debtors such as Roda, when more owners use their Community voices. It is your money, your resort, get involved.

Still Entidad Board meetings should be interesting, hopefully she will not be welcome, by a good make up of board members.

You did extremely well to get 40 proxies together Chris and I'm really pleased you've been elected.  It's simply not enough though when up against Roda's multiple property voice, and it really does beggar belief that presumably the new board's most pressing issue is to deal with outstanding debtors, and yet our biggest debtor is a squatter on that board.  Is that not like asking a turkey to vote for Christmas?

I too wish the new board well.

We have received notification of the new Board members and good luck to all of them. I agree that the main issue is follow up of debt as if this figure continues to rise it could leave services at risk like we have seen in other places. It is quite sad that there were only 40 people there and only 40 proxies given. 80 people of 1200 is scarcely representative.

Whilst I agree with Chris about owners getting involved, in our experience the problem with people getting involved in our previous community and entity was that when people actually volunteer, if there is an unpopular vote taken later, they are derided and vilified even though they were democratically elected and probably did the best that they could. My husband was involved for two years in our previous community in Alicante region and had a horrible time with owners constantly undermining the committee, spreading unfounded rumours with a steady whispering campaign and that was only the British owners like ourselves, God knows what the Spanish were saying.  Sadly it seems to be par for the course that when people put themselves forward for a job they are then the scapegoats for everyone else and hopefully Roda will be different.

Another reason that people don't volunteer is the huge responsibility and personal liability involved in being President or a board member should a wrong decision be taken and we were quite taken aback by the law in Spain in this regard.

So well done to those who did volunteer and got elected (at least they represent the small percentage who bothered). Hopefully we can look forward to an immediate plan of action on how to reduce our debtors and that would maybe stir up some interest from owners and get more people out next year.

Isn't democracy a strange and wonderful phenonem?

Roda Golf SL who owe the Entidad close to 50,000 euros manage to get a representative elected to the board utilising 104 votes of properties or holes in the ground at Roda that they own and do not have debts on and still manage to attract votes from another 50 odd owners most of whom were present at the AGM despite the fact that at last years AGM voted to exclude debtors.

Yet willing volunteer owners prepared to offer their time and experience are effectively ignored.

Worse still is the fact that a maximum of only around 130 owners out of 1200 properties even bothered to have their say of send a vote via proxy as that was the maximum vote acheived by any of the other candidates.

Owners do not have to get involved with their time and effort but you would think they may like a say in who represents their future at Roda.

How on earth do we inspire some interest and concern for their investment of over 1000 owners?

If Roda are not paying their debts are their renters being denied access to the swimming pools where the wristband system is in operation?

We are always informed the properties they own are not rented, apparently many were purchased but not completed on.

Caildona Rentals, manages and rents out property on behalf of owners who would have to be paid up to receive wristbands.

No wristbands are issued to properties with current Community debts unless an agree repayment plan is in place.

No one can guarantee that Calidona Rentals or any other property manager for that matter would not pass on wristbands they have collected on behalf of fee payers, we all have to trust in their integrity.
