Hi Evereyone,

We have a damp problem around the inside of our front door. Ours is a penthouse apartment in Block 22 on phase 1. Its at the corner with the kitchen wall not the dividing wall between us and the next door apartment. You can also see where the plaster on the outside wall has blown and fallen away.

I think I read or heard soemwhere that similar problems have been encountered by other owners.

I have received a quotation for a local builder who has insoected the problem and concluded that it is due to poor workmanship on the build relating to the drainage of the water from the roof and related poor waterproofing.

Roda have said that I need to claim of the community insurance but I am sure its a problem with the build which they should be responsible for.

 

Can anyone shed some light on this? Has anyone had a similar problem and if so how was it resolved?

Any info would be greatly appreciated.

As described this sounds like the classic problem with the DPM around the front door and drainage, especially iof the outside render has blown as described

The other thing to check is to make sure that the water is not coming in from the top terrace area and collecting in the wall cavity, causing the damp so you have to make sure to repair the terrace, oftern where the grounting and DPM fails around the edge of the terrace

The problem with the community insurance is that they will cover the repairs to the astetics, fix the plaster inside and repaint, but not do anything about the source of the problem

If it is  a building defect then the claim, depending if the property is less than 10 years old, is on the 10 years NHBC type policy in Spain and the Adminsitrator can give you the details of the insurance company that is providing the cover

You may need to first commission an architects report but normally they will come and inspect the damage

Forget the developer as they will just pass you to the building insurance scheme

If you have your own buildings insurance you could also claim on this which is nornally much easier

I'm no expert but I suspect that if it is a building defect then the community insurance is unlikely to cover this. The Community insurance tends to be fairly basic and only covers simple problems. Contact Resortalia though to find out.

Roda won't be interested - they are no longer paying community or entidad fees on many of the properties they still own so will likely ignore any problems with the build quality.

Regarding warranty - yes well there's supposed to be one but many owners have tried to claim for building defects but I'm not sure whether anyone has had any success.

As Roy says, your own building insurance is likely to be the quickest method, but again they may refuse a claim on a building defect.

We have an ongoing damp problem.  Tried insurance but to no avail so had to pay for it ourselves. The builders are trying their best to solve the problem, but they still can't get to the bottom of it.  Poor workmanship in the building of this 5* luxury development.
