A new group has been created to put pressure on Spanish authorities to take their responsability so that our homes can be built.  We do not beleive there is any other pheasable way of avoiding loss. We must also see to it that our land is not sold off at a cheap price because the planning permissions have not yet gone through or end up in the hands of those who have already presented embargos on the land. We've all dreamed; now, let's get it done!

I have just returned from Spain, while I was there I thought I would go and see my lawyer as I had not told them or used them for my Trampolin Hills dealings so far.

I had also made my mind up that getting my money back from TH was nothing more than a dream and so although I have joined various groups had decided not to throw any more good money after bad, but last Tuesday I went to see my lawyer on this subject.

I will try and remember all he said, though I cant promise that it will be in the correct order he said it, nor should any of you start any arguments as you have heard different from your solicitor I am simply telling you the outcome of my visit.

So I started by asking if he had heard of TH, his answer was,

Not only had he heard of TH but some of you will be his clients, he has already won cases against them, but it seems that only 2 outcomes have been reached , that is that clients did not get their money back but had embargo's placed on TH properties, the other was that those winning clients also had their contracts cancelled.

The other dealing he has had are that an estate agent got in touch with him and said that they were very concerned about the selling of properties for TH, so a meeting was set up with him and the estate agent and Antonio (you know the one they call the gypsy) my lawyer asked about planning permissions and bank guarantee,s etc , at this point Antonio threw a fit screaming at my lawyer , he did not have to prove any thing, he only mentioned that he was doing things how things were done in the building industry just like Polaris and others.

My lawyer is also representing many buyers on El solera.

So now back to my case, TH were forced into liquidation which means the owners now have no say in its dealings , a highly respected man has been appointed to deal with their assets and debts and his report should be completed by approx Easter next year.

If he finds that TH have money , lets say he can find 1 million Euro's for example, then that money will be distributed to the people or companies owed , however its not that simple because it is paid in priority order, for example if TH owe money to the government they will be top of the list, my lawyer mentioned several high, medium , examples and guess what , us lot are the lowest , our chances are by far the smallest.

My lawyer is dealing with other clients who have similar problems to ours with other developments, but told me that TH is the worst company in Spain, he said though possible he thought it highly unlikely that the TH development would be taken over as some of the other struggling developments have been, also those of you like me who have not yet had your contract cancelled by now are too late, which is a bad thing, should any of you like me, not want to continue with your TH property, your contract can be enforced and passed on to the new company should there be one.

I told my lawyer that I did not want to throw any more money at this, but he told me a few things about the good work of the man with the job of auditing TH and that it must be worth persueing as there may be a chance of at least seeing some of my money returned, so I have instructed him to proceed and put a claim in to the creditors which most of you will know has to be in by December 2nd or 3rd 

I suppose he told me a lot more than this but this will do for now, as for my opinion on TH going a head there must be many buyers who have had their contract cancelled and may more who now cant afford it and those who simply don' t want to continue and there certainly are no new buyer's so who will buy there, there's no chance of it being the same size development, would you take it on ? build all those houses ,  honour the deposits already paid , no neither would I, my 66,000 Euro's would sure come in useful now, but for sure I wont be a resident of campos Del Rio.

Of course the government and the politicians will get their snouts in the trough first. I bet we don't get the 7% IVA back from all of our deposits!! In your case Evad, Euros 4620.  Unbelievable. "A Place in the Sun" has got a lot to answer for!!!!!!!!!!!!!!!!!

Thanks for sharing your experiences

Through my discussions with lawyers in Spain I will trey to share with you what they told me

• The embargoes that has been put on the land by some of the customers will be erased by the bankrupsty court case and we are all equalized with regards to the refund of the money (which will be peanuts - if any money back)
• The land posessed by GT on Trampolin hills is rural land, and they have noe even paid for it yet, This payment is supposed to happen when the land is converted. And there is a BIG difference in price with regards to rural/non rural land
• There are on-going cases towards GT as a Company for bankruptsy claims , Antonio & Co for criminal activities and the political process leading to this
• There is also a lot of money paid "under the bricks" thus, criminal law suits against Antonio & Co
• It is not final that the project will not move forward, but none of the persons I spoke to in Spain thought that the trampolin Hills would be built. (Incl. Lawyers and Comercial court no 2)
• The lawyers thought is was a good idea to bring it on to a National or EU level - A lot of other projects in Spain has gone bust, but none of them in this scale with so many houses sold (=customers) and so many indiscrepancies and illegalities.

 Ogo you are correct as I said when I posted about my trip to Spain I wrote what I could remember at the time, but yes my lawyer told me that they have not even paid for the land at Trampolin Hills, Also I mentioned to my lawyer that a European ruling or intervention may help us, and he said he very much hopes that it is taken to the European courts as the whole situation is un regulated, I said to him that we had been let down by the Spanish government, they have not enforced the rules that they have made which has led partly to the situation we are in .

When I bought I was offered a 50,000 Euro discount to take a company guarantee, which I accepted so I suppose that's my fault to agreeing to it , how ever if the law had been adhered to I would of been given a proper bank guarantee and if It was 50,000 Euro's more I would of either had to pay for it or had to decide whether I could afford it or not. As it was I thought at the time I was getting a good deal, but none the less we should all of been protected by the Spanish laws already in place.

If any of you like me joined the afectadostrampolin group you will be inundated with emails I'm getting between 25 and 50 a day but they are all in Spanish so I have no Idea what is going on.

I have an opinion and when I expressed it the last time I received a un sympathetic reply but once again this is my same opinion,         Spain has rules and laws etc which they have not enforced certainly when it comes to the building industry, Trampolin have no money or certainly they do not have all our deposits to return to us, so I feel that to take legal action against them will not get our deposits back , though we may see a small amount  before we die. No in my opinion is we have brought millions of £'s or Euros into the Spanish Economy and as far as I am concerned the Spanish government should be urged to take responsibilty for the situation they have allowed to take place, and as such I think that they should pay us all our full deposits back and if do not do so voluntary, should be made by European courts to do so.

I agree with you totally the only problem is when has the Spanish Government ever done anything that the European Courts have told them to do!!!

Now its asked for the assistance of the authorities to avoid an international scandal whose effect would be a deepening crisis that has already affected the housing sector with major impact). The reality is that we have hanging in the balance our money, depending on how we fight to defend it, inorder that in the end we lose the least possible. if we dont move now then soon each day that passes, there is less and less money to fight for.

I hope this makes sense as in my opinion it seems the governing/ administration organising the creditors list do seem to leave the buyers with very little after all is organised. And as I have been told can award themselves a large part of whats in the pot first for themselves which is unjustifiable.

In regards to previous email I sent I have sent my complaint  see below via the web page mentioned and have had this translated for anyone interested. I have really only filled out the box where it asks your complaint and of course my details and just pressed send (enviar) hope someone reads it ! La situación es que soy parte de un grupo de más de 2000 compradores de propiedades en el proyecto Hills de Trampolin. Esta empresa ha entrado ahora en administración y ha dejado a los compradores ahora sin sus ahorros de toda la vida y ya en la ruina y sin casa  (y especialmente que parece en mi opinion, después de las cantidades asignadas a la administration, antes de los compradores ,al repartir cualquier dinero que es dejado, que los compradores podria ser dejado con casi nada. esto sera muy injusto).
 Mi pregunta es cómo es que un país como España, en la Unión Europea no es ateniéndonos a los normas básicos y verificación si esta empresa mayor en España (Grupo Trampolin) han puesto en venta las propiedad illegal que muchos españoles y extranjeros han pagado grandes cantidades de dinero para su casa. Y que el gobierno de España podría beneficiarse enormemente de los estranjeros entrando su dinero a esta empresa Trampolin Hills y que se paguen así sobre estas sumas los impuestos. ¿Por qué no compruebe el govenment/administración que esta empresa fue promover enormemente propiedades ilegales en gran escala como no contaban con los permisos.Para comprobar si el negocio de Trampolin era legal es es un trabajo basico no? Esto es no aceptable en la Unión Europea que tanto dinero ha sido cogido de tantas personas en gran escala para propiedades ilegales. The situation is that I am part of a group of more than 2000 buyers of properties in the project Hills de Trampolin.

This company has entered administration now and has left to the buyers now without its savings of all their life and many in ruin and without their house (and especially that seems in my opinion, after the assigned amounts that would go to the administration, before the buyers, when distributing any money that is left, that the buyers could to be left with hardly anything. this is  very unjust).
My question is how it is that a country like Spain, in the European Union it is not doing the basic checks and verification of this big company in Spain (Grupo Trampolin)  that had put for sale illegal properties that many Spaniards and foreigners have paid great amounts of money for .

It seems the government of Spain could enormously benefit from the foreigners entering his money into this company Trampolin Hills and that taxes are paid on these sums. Why did the administration/government not verify that this company was to enormously promote illegal properties on a great scale . In order to verify if the business of Grupo Trampolin was legal would be a  basic thing to do considering the huge promotion in Murcia? As I understand it is not acceptable in the European Union that so much money has been taken from so many people on this great scale for illegal properties.

In my opinion this situation should be investigated as to who owns owns this responsibility as again in my opinion it seems that the Council of Campos del Rio/administration allowed the enormous promotion of this illegal sale which now he has left many people and pensioners destroyed economically and that, now their only option looks like to be to go altogether to the European Union directly, if not given back their money in full ...that is only fair.

..P.s this has  now been sent and hopefully will be taken on board as many people look like they are sending the same thing..

Regarding EU:

Does anyone know a similar place to post a complaint towards the European Union. I have tried to get some recommendation from norwegian officials of where to contact EU - but they really did not know, they would check up on it and phone me back.

I have found several EU sites that maybe could be used, They are: 

- "Your Europe",
- A network called "Solvit",
- A network called the "european consumers network" and
- "Europe Direct",

but when we file complaints we must do it into one "hotspot" so that we can get heard - and follow up with mails and phonecalls!!!

Does someone know which website in the Union that we shall post complaints to to make it "burn"?

We all agree that the possibility of having our money back from the Trampolin Company is "impossible", but while there is still a chance of having our homes built, I prefer that to being stuck with a piece of useless land, which onbviously will cost  money and a lot of effort to register, get plans and licenses and build on and which, since my home is an apartment, meens having to cooperative with a number of other buyers. Let's rather see if we can get our homes built by those who have already been paid for that, with competent help. And by the way, we are all buyers who just want to avoid loss; why should any buyer have  "hidden interests"?
