Judge fears massive losses for buyers at Trampolin Hills in Campos del Rio, Murcia.

Buyers at the Trampolin Hills residential golf development in Campos del Rio could suffer “massive losses” as a result of planning irregularities at the resort, a judge has warned.

In a statement on the 12th May, reported in Murcia’s regional paper ‘La verdad’, judge José Miñarro García said properties at Trampolin Hills “appear to have been sold without appropriate administrative licences.” The developer admits that most of the resorts 2,575 properties have already been sold.

The judge condemned the municipal government, run by the socialist party, for turning a blind eye whilst hundreds of properties were sold without all the appropriate planning permissions.

In a little bit of good news for owners at Trampolin Hills, he also stressed that the town hall would have to compensate buyers for any losses resulting from a purchase of illegal property at the resort, not far from the city of Murcia.

“If buyers suffer massive losses, which is hypothetically possible, then the town hall, having allowed the construction and well publicised sale of properties without appropriate planning permission, is clearly responsible for damages,” Miñarro is reported to have ruled.

The ruling is a result of legal action taken by the opposition Popular Party (PP) against the Socialist-run local government, whom they accuse of changing the urban plan for Trampolin Hills without the support of the town council, as required by law. Some socialists are reported to have private business interests in the resort.

The judge also ruled that opposition PP have right to debate and vote on planning decisions relating to Trampolin Hills, and demand a halt to all works until the project has all pertinent permissions.

The judge said this would help to prevent a situation in which demolishing illegal properties at Trampolin Hills was ‘socially and economically’ unviable.

Trampolin Hills has been marketed heavily to British buyers, offering estate agents commissions of close to 20%.

 Anyone else joined the action group that was posted on the last thread, I joined and today have had 12 emails come in and they're 

still coming , unfortunately they are all in Spanish so its not much help, with my limited spanish I can only make out a few sentences.

To those that have joined the action group mentioned by Evad I can say that the numerous e-mails recieved as members of that group seem to be just some members of the group being on the same e-mail list and voicing some suggestions and concerns. The most important emails that had been sent by this group were one or two which firstly just predicted that this situation was going to happen and secondly the information below.

They have said that this manifestation would add weight and draw attention to the situation and help them in their effort to look for  any compensation and are stating that it is really important and that they said the more people with their families the better .

If you need any more info then you would have to contact the group via email and if you are needing legal advise specific to your case then you would need a lawyer (either contract your own or contract one via the group )

Lastly the news in the press is that the "juzgado de mercantil 2 de murcia" has stated that those creditors that the company owes money to, have one month to explain to this court about the debt that is owed to them by the company , so this can be known by the administration. However, not knowing much about this process it seems that people can go there in person to the above mentioned court (or send their lawyer) to add their name on the administrations list of debts against the company if this is their situation, or for those belonging to the group then await further information from them.  There was also an email given to me by someone that said you could also send an e-mail to  tcosta(at) 20minutes .  es to tell them your situation as it may be that they can forward your info to the administrators in charge of this list for you.

This advise has been forward so again you would need to contact those contacts above directly for more clarification.

if anyone can find out how to contact the administartors i would be very grateful cause it just says all creditors must be made known to them within the month but we dont know who they are, what information they need or how to contact them. If anyone can get me the answers to those 3 questions i would be grateful

Hi again...As its early days im sure things will get clearer as we are all searching for the same info you are. As far as the administrators are concerned,  the newspaper "la verdad"  did give the names of 2 of the administrators on the commitee as the lawyer Alberto Martínez Escribano and the economist Carlos Llarena,  but no direct contact details as yet. For this reason someone told me that it would be good to go in person to the court (or your lawyer) which I mentioned in the post below which just to confirm is  the "juzgado de mercantil 2 de murcia" but thats all I have myself at the moment to go on.

Apart from the info above you can contact the "group action" (infoatafectadostrampolin.  com), which has been mentioned before and of whom for those that have put their names down as members should shortly be getting a communication about more on this theme and maybe giving some instructions, of which we dont have yet. Its for this reason that some may prefer to contact their lawyer directly who can then instruct them fully on this type of process.

 Hola All, I have sent a copy of my contract to afectodostrampolin and the details that they ask for on their web site,

I am still receiving many emails every hour but as Sollel says they are from other members who are expressing their views opinions,

The other problem that I or we have is that every response from afectodos is in Spanish, we could do with someone contacting them to see if Engish speaking members can have their emails in English, while I'm typing this they have just emailed me again, thanking me for sending the copy of my contract, which I was able to translate because it was a very short sentence but any more and I am a bit lost, there is some appointment made for 14th Nov I myself will not be there until 21st of Nov so will not be able to attend , is anyone else thinking of going ?

Sollel I may be wrong but are you Spanish as you seem to be able to translate Spanish very well, Or is it possible for you to contact afectodos about the English speaking members having their emails sent in English.

In answer to question, I would like to say that as you know we are all scratching for info. I came across this group as they were the only onces that seemed to be making themselves heard. They were giving out pieces of important information and looking to go to the media with great numbers and within this group they are looking for the best action to take (which it seems they are looking into criminal proceedings now that with the company going down and lack of funds, this is a way for the authorities to trace any funds transfered to third parties etc) This group seems to understand the complexity of the situation and has lots of knowledge. They have also quoted quite low prices for those going the legal action route with them and deciding to denounce, as they charge around 350 euros to do this which yes..seems cheap but again you would need to speak to them directly about this.

However I am quite aware that organisers of the group have instigated this group inorder to do very well out of the whole process, as you can imagine with many people on board will make a handsome return. I must say at this point that as you know the situation this week is developing rapidly inregards to the company going into administration and those of the group are pleading for instructions and more info from them of which we are still waiting (should it arrive will forward) I would imagine that the organisers are now waiting for people to ask to contract them directly for legal services as this is the way forward for them instead of giving out more of their info as they are a business afterall, although for those looking to put themselves on the creditors list its still unsure if they would need to take legal action. I would imagine this is why we are lacking info from the group as if you arent contracting legal action from them then they dont make money.

As you can see there are always 2 sides to a story and the group as a whole is however putting pressure on the organisers for more info as they are looking for concrete advice and peace in regards to the creditors list, so heres hoping that the organisers of the group forget there short term profits and give more of their information which is usually very informative and extremely helpful. More info on group received today...message just recieved in from the group stating the e-mail as given in my previous post for sending your request to join the group and also stating that the e-mails sent to that address will be shared between the 190 members.
 

It also states that the association does not give legal advice as they are not lawyers and that this group is a place for people with the same problem but however that the group does have a lawyer that gives them some legal advice. The sender of the info who's name is joaquin Guzman has said that you can write to him in English or spanish incase he may be able to answer your queries but at the moment he is replying in spanish but has said that you can translate it using google . es language tools. Again for real indepth legal advice you would have to contract a lawyer through them or one of your own.
