Hi folks

We have been offered an exchange of properties from one of the apartments to a town house. The developers are wanting us to move quickly in the purchase but our solicitor is refusing to exchange contracts with them until we have the first occupation licence. I have read a few threads where they have signed up without the final habitation licence. Is there a difference between these licences and what is the general consensus on this. Any advice would be much appreciated.

Hi Folks

We closed last week without the habitation license. Pulpi town hall are issuing no more habitation licenses until the site is completed. Our solicitors strong advice was to close and have title to the property as this was a safer route for us. We agreed. His thnking was that there are now sufficient people in possesion of properties in CDP that if anything were to happen to Peinsa we would be in a strong position to ensure the site can be finished. The town hall will have responsibility in this as well.

I dont believe they will buld as big a develpment in the current climate and it may be that what you now see is what you'll get. Hence they are anxious to try to move poeple in to available properties in the existing phases.

We are happy with our decision to close and delighted with the alternative property they offered us.

Hi

This post is a bit misleading, sean & margot you have decided to go ahead without a habitation license saying they will issue when the site is complete. then you go on to say you dont think they will finish the site, surely if you think or have some information that the site will not be finished  you should not have signed as the license will not be granted.

sharon & Dave our solicitor has told us to sign, we have had the property snagged but we will not sign until we get some sort of guarantee off both our solicitor & the office regarding completion of the site & Habitation License.

Sorry Guys

When I say I dont think they'll finish the site, I mean it in the sene that it won't be as big as it was originally planned. For example I would be surprised if they build on the sites near the car park where the market is held and similarly where the bungalows are planned up at the top - I know they are currently offering the people who bought there properties in the existing phases. Hope that clears it

Our urb has a partial habitation licence, I think although I may be misunderstanding the situation that the town hall wont issue a full licence because the site hasn't been completed as per the plans that were granted planning permission. The final phase is never going to be built and I think the town hall are waiting for revised plans to be submitted (excluding phase 3) for retrospective planning permission. But I may be completely muddled in my thinking, it was a google translation from a Spanish court judgement!

I'm sorry if I have caused any confusion. I just repled to a thread I saw on Latest Forum Posts and didn't realise they were community specific.

The urb I was referring to is on the Costa Azahar but maybe the logic of the court ruling would apply anywhere.....hmm.....then again maybe not! I have sent a copy of it to another member of EOS, I will try and post it on here if people think it would be helpful.
