Just when you thought that San Jose could not get any lower!! Some of us that are in Spain awaiting developments with San Jose and residing in one of their properties received notice to hand in our keys and vacate our properties before the end of December - strange as our contract is until the end of December and in that very same contract there is a clause stating that if our house in Jumilla is not ready for occupation by the end of December 2008 both parties will discuss a new arrangement.

It appears that we must have missed this discussion stage because certainly no one from San Jose has had the courtesy to tell us about anything or respond to several e mails and verbal requests from me over the last few months regarding what our position will be when the agreement expires at the end of December. 

I cannot say that I was too surprised about the content of the letter but I was saddened by the timing of it and hope that Eberneezer and the rest of the San Jose have a pleasant Christmas but a far from prosperous New Year.

To those of you at this 'festive time' still wanting to do business with and own a San Jose property then 'God bless you, everyone'  and let me try to find another piece of coal for the fire!!!!!!!!!!!!!!!!!!

There is only one couple living at La Zenia who have a home in the UK so technically we are all homeless, though SJ will have to take me to court for my keys and it could take them 5 years who is having the last laugh now

Ummm, if you don't know, there is something wrong.
Are you laughing at the fact that they have taken your money and given nothing but grief in return?
If you are happy in holding onto keys (temporarily) of one of their premises, in return for them taking your money, then that is strange.
DEo you believe that the Courts would come down on your side if there was legal action taken to recover the premises? Is the premises registered in your name?
Time to get real. Who has the last laugh only you may know, but one thing for certain, they have your money?
So, would you prefer the last laugh or your money?

Hi Linda

How many people are in temporary housing through failure to complete properties on time or breach of contract etc?

The places your living in at Le Zenia.....are they like mortgaged or sold to others people or owned by others or something?

Its a new one for me this, i didnt realise it was a big problem.

 now now people. have a heart its christmas and almuns baby is due. She didnt have to stay on. She is just trying to sort this mess out for everyone (and evict you all by christmas!)

 what I do is my business &  if I  need input  I will ask for it I know exactly what I am doing

Brian there are 13 couples who have been given accomodation along with a contract saying we can live here until our place in Jumilla is built they  will have to evict us en mas so will be giving a copy of my letter to the newspapaers so they can cover it

I would think they will have to have a shoot out to get you out!!!!

Hope the lawyers dont cost too much, its at times like these you need a decent one though i would think..........and the press should be more than interested eh

If we look back over the last few months, if your not pinning hopes on the 'maybe they will let me have my house', its all been leading towards the administration delivering a report thats there for all to see.

Then its a case of whats the best option.................and its looking that the Herrada best option could be to close the site completely until times are better.  Which means a pay out or a winding up..................dosnt it?

So in that case you could be right....................if they dont tackle this issue head on and give reassurances................it does look like the end of the road for HdT.

The contract for the apatments are with San Jose nothing to do with HdT !!!!!! so can anyone tell me how that concerns us in La Zenia

Last Thursday the court sent a letter saying the administrator report was ready. I called to your Procurador and he told me he was going to send me the file today. I will send to you a copy of it (They told me it is a very big file).

About the other two questions, about the buildings we don´t know oficialy anything. And about the other question, some people (few people) that canceled the private contracts before the builder went to bank krupt and some people with bank guarantees they are trying to get the money back. You are not in these cases. 

The result is: the second ones (bank guarantees) will received the money from the banks where the guarantees were (they are few people and the problem is that probably the bank guarantees don't cover them); the first one have received the answer from the court: your contract is canceled but about to give you the money back we have to wait what the administrators say in their report. The final result is up today nobody has gotten the money back (the Court hasn't said anything about it).

When I study the report I will say to you something.

Well Friendinneed.

Anyone that has bought at SADM has paid thousands of €s as a deposit. The only difference is that there are just a FEW who are living the spanish dream in an appàrtment in La Zenia ALMOST free of charge in most cases, paying utility bills. San Jose can send out what letters they like via their lawyer or not but at the end of the day, NOBODY is going to leave there until a court says they must, and we all know in spain what that means. Mañana. Mañana. Mañana.

Spain as with the U.K., tenants have certain rights. Such as: Squatters rights or sitting tenants rights. At the end of the day right or wrong, agree or disagree, it still comes down to: Mañana. Mañana. Mañana.

So it may not be the LAST laugh that Linda and the other tenants have, but  as far as San Jose and any other creditors go, It comes VERY VERY CLOSE, as Robert Redford said in the film The Sting.

P.S.  We are ALL owed money but some of us have an appartment, so mocking Linda is not in context Friendinneed, unless of course YOU have an appartment.

So a few squatters are causing as much heartache to the directors of SJ, as the loss of their money is causing to the squatters. Now be real.
Those few squatters, living looking over their shoulder, not knowing what exactly will be happening in 2009.
Bet the directors of SJ will not go hungry over Christmas, nor  2009.
If they were to read this thread, they would certainly have the last and longest laugh, knowing that they have taken your money, you have not had your house and squatting somewhere which they probably do not own, as Banks and creditors will have claim on, and that makes you happy and laugh.

You are in the same boat as us but you DONT have an appartment. We are NOT looking over our shoulders, we are just waiting many months and even years to be OFFICIALLY told by the court to leave. 2009 will look after itself and if San Jose want to get a court order then they can get on the queue behind the rest of us CLOGGING up the court.

We wont be going hungry over christmas or in 2009 either.

I hope you are right FriendinNeed and that the banks and creditors have claim on the appartments, as it will be a long time before they get any money either. A long time.

SARCO are waiting for this report and the outcome as though that will be IT. Sorry this is just the beginging. Nowhere near the end. Nowhere.

"You are in the same boat as us" - Don't be so ridiculous. Try reading other threads and psots.

Most serious is the fact that if anyone thinks they have the last laugh over SJ, who hold your money. Then they are in denial, no doubt about that.

How, how on earth can people have money taken from them, then consider they have the last laugh as they are squatting. Do you realise that to squat, you don't first have to part with several thousands of your money?

i agree with Bob but take your sentiments on board as well, yes we are owed money, similar to yourself and many others ( i cannot remember correctly if actually you are owed money - you've never stated the fact). however, a few of us had similar thoughts in the beginning and took San jose up on their offer to accomodfate us here in la Zenia. as i mentioned, we are all owed money but some of us now have a life in spain to build upon regardless  of where we live and if its legal or not.....you are the first to say openly what SJG have done is illegal so why should it bother us if we 'squat' as you call it and worry ourselves about legalities. When we personally negotiated this apartment, we agreed to pay a nominal sum, €60.00 per month, for utility bills........in the UK we paid more than that for telephone let alone mortgages and bills etc so we would have been foolish to turn it down. In addition, it has given us the opportunity over the year to be close to a) SJG and what has happened...........we all heard it 'un-officially' through the Spanish grapevine although little we could do about it b) closer to our solicitors so we dont have to continuously rake up phonebills chasing progress. My solicitor is 5mins down the road and we regularly get updates and considerations given. That would not be the case - in my own opinion - if i had been still in the UK.

lest not forget, we who reside here, are living the Spanish life, if not the spanish dream we all dreamt of at the beginning of this journey - I now work here, am registered as a resident and pay into the social security system. I'm sorry to be blaise and recognise many are not so fortunate........but we are living our dream, our ambition......and yes we have lost or are losing money along the way, doesn't make it get any easier but that's life, we lose a lot along the way in life, the hardest thing is family and friends.....at the end of the day, if i lose money, i still breathe air into my lungs............tomorrow is another day for living.

So glad that there are more than one that think it so funny, that they have the last laugh.
If is was me that was owed money, I would rather have my money back and to hell with who has the last laugh.

"and if its legal or not" - OK if those are your sentiments, you can see why many callegedly crooked agents and developers share them and show no respect to purchasers when things go wrong. Should they worry if it is legal or not?

I just find it strange when people have lost their cash, scrape to make a living, feel they have the last laugh.
