This dosen't help anyone but I felt I had to do something otherwise I might do serious damage to someone if I don't have a rant. Emailed my solicitor in Aguilas today asking for a contact number for Cajamurcia so I could make a complaint about the inordinate amount of time they are taking to pay out on my guarantee, it has been nearly 8 months now and all I get from my solicitor is we are very close now. In fact about 6 weeks ago he asked for my Bank Account details as the the bank, according to him, was going to pay my money within 3 days. Needless to say it didn't happen. He then said he was going to sort it out before he went on holiday, yet again it didn't happen. He has now been on holiday almost 4 weeks, so I contacted on of the partners today. The reply I got back stunned me. He said, and I quote " This is the last time I will tell you not to interfere with our delicate negotiations as our reputation will be questioned and we will not be able to act for you .We are dealing with high representatives of Cajamurcia. The office manager of Mazzarron will be back from holidays next Monday and we are awaiting his phone call to transfer funds into your account.
This was all because I phoned the Manager at Mazarron and asked about my guarantee and all he kept saying through an interpreter was it will be soon. Can anyone tell me what it is that I have  done to elicit such a curt response. It's my Guarantee, its my money, so why shouldn't I ask  questions?. This farce has been going on since April 2007 when I instructed them to cancel with Huma. That scenario went on for months and amounted to nothing, and so we then went down the BG route. To be told in effect to shut up or else has just added insult to injury but it'sno good changing solicitors now so far down the line. They have really upset me but I know it is Cajamurcia who are the real villains. I just don't know if they are being proactive enough.
I have lived and worked in Spain for a year now and I know only too well that most figures in authority over here just play games with the law, it is like a national sport to them, push it and see how far you can go. Then just rely on the cumbersome Spanish judicial system which takes forever. then go to appeal, and then hope Johnny foreigner just gives up and goes away or dies from the stress in the meantime, and beleive me I am not joking.
If you have got to the end of this without falling asleep thank- you for taking the time out for allowing me to indulge in my self pity.

Bless you !!   Please don't feel that you have to apologise for your post. You have every right to feel angry and frustrated. These situations are common and test even the most patient of us to breaking point !!

We ( and probably others too ) have been in the same situation where you feel like you need to take matters into your own hands because nothing seems to be being done. You are right, these tactics are to make you feel like just giving up. 

Recently, we became fed up with waiting patiently, and did a bit of investigation ourselves, looking at how we could get the bank to comply with the law. This upset our solicitor very much, he warned us that we could be putting our chances of success at risk by interfering.

I think that what we as brits don't get is that the spanish are culturally very different. I have found that if you get impatient, or annoyed when dealing with them, they become more determined to make you wait even longer. If you really upset them, then they just simply refuse to communicate with you at all. If you are living in Spain, have you had this experience with them before?

You must know by now that in Spain, the corrupt are regulated by the equally corrupt, and THEY  are regulated by the VERY corrupt,
it is about time the government stepped in and ordered all of these developers to repay their clients without it costing them lawyers fees.

Anyway, your solicitor should not think he can be rude to you, after all, you are paying him !!!   You are right though , if you change solicitors, it means more expense, and can take even longer.

Try and remain positive, and what ever you do ---- Don't give up !!

Annie,

Same bank is holding on my 2nd payment. My solictior returns to work next week, so will hopefully have more news. Have you read the posting on another thread about banks not paying out and its illegal? I post link here to save searching. Maybe try to find out a contact from this posting and tell them your story??

Really sorry to read the distress you are going through. (As many of us are going through.) It is the worst nightmare.

Easy to say but, reading your note, if I had received comments like that I would be up and fighting even harder. How dare they, any of them, try and get you to 'back off.' 
That's how it reads.  
Go girl -  take a copy of the news paper article in the link below send it to them (Bank / Solicitor) and threaten them with every organisation you can think off. Then write to those orgs.........
If necessary get a LONDON lawyer to intervene and write. (This is what we did and it semed to move things faster !)

This is the type of action and it appears the only action they understand in Spain. Certainly do not sit back and take their fob off''s about reputation ........ bla bla bla. Antojo is correct, these tactics are to get you off their backs. (because everyone wants and has an easy life in Spain, no grief please:-) 
My solicitor told me (when I had my refund in my hand) that 'my  persistence paid off ' !!! Too bloddy right it did. But it's not easy I can tell you. (and it's not over for me either as I still fight for my €12000 first payment via litigation and court action.)

Problem is, right now the Spanish banks / Spanish property industry / the economy is in a complete slow down and has crashed. That regretfully is what we are all up against. That said,  they still owe you your refund.
