I've hired a lawyer in Spain. Had to go to the embassy and make a power of attorney.  I've spent about 1K Euros so far.  But can't let them get away with it.  I put a deposit down for a similiar amount also in 2004.  the agency Garu sold me the unit.  I think the case will take some time.  Grupo Mirador didn't apply for the proper permits and the property has been attached by a bank and the tax bodies.  I think the project itself is a write off now (i.e. no chance of it being built), hopefully GM has some assets which can allow for recovery. If you want to join the case, the lawyer's name is Patricia Morales but I am not very optimistic about getting anything back.

Also, I made official requests for getting the desposit back but had not even a single response. I made several offers to use the deposit for exchange for other properties but never heard back.  I'm too far away to get to Malaga quickly, do you have a chance to go there?

I hate to say it but this will be long and difficult.  I have recently hired a Spanish lawyer to develop a criminal case against GM.  They never responded to any of my letters, faxes or suggestions.  I made a deposit on a property in 2004, about Euro 48K.  While I will proceed with the criminal case, I have formally written off this amount on my US taxes to get some relief.   As I have been told the Spanish court system is slow, I don't expect any results soon.  Most likely the company will be liquidated at some point.  Hopefully the courts will freeze any personal assets of the management but I would expect less than 20% recovery and that is really just a guess.  I have no idea if they have any unencumbered assets.

Well it's been four years since I made a deposit for an apartment at Mirador de la Fortaleza.  They still have done nothing.  I don't even think they have a permit.

Please research any company before you do business with them and demand a bank guarantee.  If they can't give it.  Just don't do it.
