Good morning to you all,

What a minefield of legal wrangleing for consumer rights and protection for the return of hard earned cash deposited with these despicable promotors and their henchmen.

They have no shame when it comes down to giving up the millions of euros they have squirreled away for their forced retirement after conning their victims with the corrupt practices that they have employed to convince purchasers that their money is safe buying their products.

They are good at it they even convince and hoodwink the judges and the courts that they are innocent and somehow continue trading and keeping their ill-gotten gains by pleading poverty and that they are also protecting the company and their faithful employees.

It appears they cannot give up the good life and are promoting the leftovers of their "Place in the Sun" portfolio to the next generation of victims taken in by the glossy brochures and videos of the good life.

Yes! Just watch all those scenes of glorious beaches, golf courses, horse riding, fantastic hillside villas overlooking the sea and mouth watering gastronomic restaurants. The narration promises of how safe your money and investment is in their hands.

I wonder if a television company could make a programme titled "Cowboy Promotors in Spain?"

I have not copy and pasted the information in this link. Just have a long read and read it again. The opinion given here may raise some hopes for victims of these warranty abusive clauses in some contracts.

The only downside to this information is that you must ask your lawyer if it is correct or not!

Please be aware that you must be very careful in this situation when you have a team from the developer having a site visit.

If you inform them that you have been doing any work yourself or by others on your behalf it is possible they will inform you that as there has been "third party interference." This is a question they will probably ask of you. "Who did this work?"

Always inform them it was their employees or contractors on their behalf.

Do you speak fluent Spanish? If not have somebody with you when they visit who can tell you what is going on in the conversations.

I removed an abandoned English number plated car from the underground garage it had been down there for 10 years and loaded it up on a grua.

Got it all the way back to old blighty for the car scrappage scheme.

 

The Skoda dealer gave me 1000 quid and scrapped a new Skoda!

Thank you both for your replies.

An example of the guarantee has been provided by Maria on her blog Legal tip 88.

A copy of the 10 year guarantee is sometimes provided in the paperwork when you sign for the property. As it is a legal policy provided by the promoter you should be able to obtain this from either contacting your administrator or lawyer to supply you with a copy.

Once you get the copy you will find out the information about the Optional Coverage.

Our community has over 222 properties so obviously the defect costs are higher. The legal charges are the price of going to court against bad promoters. This always has been the obstacle for communities pursuing their rights against them.....and they know it their pockets are deeper than most communities funds so ergo they treat you with contempt.

As I have mentioned the residence does not have the Optional Coverage it is specifically excluded.

The builder and architect cannot be included in the judicial writ for the reasons I have already provided.
