Hello Faro,

I was just browsing the site and came across your thread which I know this is now old; I just wondered how you got on trying to either have your deposit returned or have Feenix honour the deposit.

If Imperial did go into receivership and all or part (more than £100) was paid on a credit card you are protected under UK law but you have to prove to the credit card company that the business has actually closed down.

Hi There,

When wichmann posted his declaration that his lawyers had contacted him with a view to completion I took it with a large pinch of salt and muttered to myself 'here we go again!'.

But I was delighted to hear from my own lawyers a couple of days ago that they too were looking to set up a date at the Notaries as soon as possible.

You wait for ages and suddenly everything comes along at once!

Hi Max,

Re. the proposed contractual agreement - I don't understand.

You cannot contract with a party (Phase II Community) who do not exist.

Any agreement the Phase I Community come to with Arrohabitage will not be binding on the Phase II community and likewise anything Arrohabitage agrees with Phase I will not be binding on the Phase II Community.

You assume the Phase II community would wish to contract with Phase I as a junior partner to help bail out Phase I's budget shortfall - why should they?

How, by holding Phase II to ransom by threatening their future potential completion, do you expect Phase II to want to contract with Phase I.

Where is your 'leverage' now?

Hi Mozza,

When we were over in March I poked my nose into one of the empty wooden door'd ground level storage units in our block on phase II just to see what we were missing out on, as we decided not to bother trying to buy one, and from what you and Irene say we're not missing out on much.

I've been in the flooring industry for 28 years and know what 6 square metres looks like and that storeage unit is not it. I fear square metres have been confused with cubic metres as from memory the floor area looked something like 1.3m x 2.2m - about 3 square metres. If the storeroom is about 2 metres high this would be approx. 6 cubic metres.

If my memory is playing tricks I apologise. I hope this helpd,
