Since discovering Maria of Costaluz lawyers through reading eye on spain, I engaged her services,[ third time lucky]. My neighbour had 2 british registered cars parked at his door for 4 years and both used constantly. I expect he paid the road tax on-line as he never left the country at anytime. How he managed  or not  to M.O.T.  them both is a puzzle to me[ maybe he took pot luck and was never stopped by traffico police here in Spain.]   Lo and behold !, one day he found a slip of paper on his windscreen, outside his house........... whilst patrolling the community   the police had taken note of his vehicles and after the allotted time allowed with british reg.,    they acted on it.      It was from traffico and my neighbour immediately  changed his 2 vehicles into spanish plates,  but also,     he had to get his headlights altered as well.  He had got away with it  for 4 yrs but it just shows the police do notice.

oops!   a little ammendment to my former message.

 

```````````````````````````````````````````````````````````````````instead of  ' for'  2007 etc.,   I  meant   'in'   2007 etc.,

Those letters were sent out in november 2011 from AGENCIA TRIBUTARIA   targeting those home-owners who have not submitted their tax declarations for the said years.

Anybody in that situation has the chance to put things straight with their taxes.   Failure to do so may lead to fines or even embargo's.  It goes under the heading   ' ANTI FISCAL FRAUD PLAN'

To cancel residencia, involves returning to the initial place where issued. One must have passport, N.I.E. and Residencia take everything relating as there will be form filling to reverse.  It would be wise to have an interpreter with you should you not be fluent in the language.

Re; tax situation.

Whether non-resident or resident a tax declaration has to be submitted through the channels every year you are a property owner.

Your completed tax return will be returned to you duly stamped by the tax office,  this is your proof.

There has been 300,000 letters sent out to those people who have not submitted tax returns for 2007,2008,2009,2010,and 2011.

The tax office has police involvement ,  embargo's[  freezing] can be enforced on bank accounts  and sadly to a house.

To keep anyone on the right side of the law ,  I would suggest  the services of a gestor / asesoria for all legal paperwork.

You are allowed 183 days per year in Spain as non-resident., and still pay taxes in U.K. at source.  An asesoria in Spain would calculate your tax return as non-resident once a year.  Should you decide to become resident in Spain, because you live here for most of the year, a tax return has to be calculated by the same asesoria or similar professional between april and mid june for the previous year...as tax resident.  All must be declared with proof etc., total income from january to december, on world-wide assets.

You would pay less income tax in Spain than U.K.  Once you have decided which category is better for you either non-resident or resident in Spain.... it is always best to do everything correctly.  Keep your tax situation in U.K. with no changes if you are spending only 183 days total per year, and remainder 182 days in Spain. This is the easiest solution to avoid form filling.

The Inland Revenue has to be notified in U.K. and form filling is essential should you become tax resident in Spain[ staying more than 183 days per year.]..their website gives all the information you would need .  It takes a little time for the change-over but it is not a daunting experience.
