We bought our property on an urbanization, it was sold by the bank as a repossesion from the developer, we have just returned from our holidays where we have been plagued with a problem of leaking water from our shower. Our neighbours below us have been flooded once, due to blockages in the waste pipes concrete and rubble. All damage repaired by the community, however we had only been there a few days when our neighbour said he could hear water in the walls, Insurance co came out and said there was no problem as there was a leak from our shower but only in garage, 2 weeks later neighbour told us his door wasn't closing again, insurance co came out again and after hearing the water in the walls knocked a hole in wall only to find an open pipe not connected to the waste system! just emptying into a cavity. Our insurance co say it is the developers problem and to claim off their insurance, developer gave apartments to bank who say it is a community problem! The community will not answer any emails and we are in process of getting new President etc in. Who should ultimately responsible, I believe it should be the bank. The couple who are in the apartment are elderly and are finding it very stressful, along with the fact that the neighbours have 8 dogs and they constantly bark, we were led to believe they were due to be evicted, but now find they have been there for a lot of years !

Hoping someone on the legal side can tell us who we should be pushing to do the repairs, we really would like to be able to use our shower!

On our Urbanization in Casares, now that the majority of the apartments have been purchased , we are trying to get a new President, present one lives in Madrid, as does the Administrator. There are lots of issues with the community, as well as debts that the community are incurring. A group of owners, who live permanently at the urbanisation, called an EGM for 8/8 , the President them called an AGM to be held on 10/9, when most people had returned home.

The current President and Administrator have now changed the bank account so that none of our direct debits for our community charge have been collected. We have managed to find the new account details and most of us have paid online, my question is surely this cannot be allowed to happen without notifying the residents of the community. We believe they have done this so that people are in arrears for the AGM and will not be allowed to vote, therefore we will not be able to vote the current President and team out. We do have a lawyer working with the owners who live permanently at the site.

Those of us not able to attend on 10/9 have given our Proxy Vote to the group that has been set up, so we are hoping that we can have a new start.

The whole community is in a real mess and nothing seems to be being done yet we believe they are collecting in the region of 10,000 Euros a month, we have very little maintenance done, very few light working, lifts breaking down.

They have not had a meeting for nearly 2 years, no accounts provided .

Any comments especially on the bank issue would be gratefully recieved.

Hi,

We have just spent our first week in our new apartment on Casares Golf and Gardens, which is across the road . Our Urbanization doesn't have many people living there permanently, but we have already met up with quite a few of the new residents. It is a lovely area and the area around La Duquesa is great. We bought furniture from a local shop and can't fault the service.Cant wait to get back over there, we're only using it for holidays at present but hope to spend more time there in our retirement. I seriously think prices have reached rock bottom, and we certainley picked up a bargain! Just out of interest which agent are you planning on going with?

We have just bought an apartment at Casares Golf and Gardens, and have now found out that very few people who are permanent residents have been able to get copies of accounts, minutes of meetings etc. It would appear that meetings are held away in Madrid where the President resides. There appear to be quite a few issues which need resolving and we now hope that as there are more people moving in we might be able to get things sorted. Question is, how can we get hold of details of the accounts etc when the president won't communicate with people?

Any legal advice would be gratefully received.

I've recently found that Norwegian Airlines have been doing some cheap flights from Gatwick. I have to go school holidays and have still managed to get round about £100 return . Use skyscanner to check flights. Norwegian also give loyalty points for bookings , haven't worked out how much you get off!
