Hi all

An issue which we have not seen raised is the conservation area around the development.  We were told that the lettering on the plan according to Spanish regulations/law indicated that this was a conservation area never to be built on.  Unfortunately, like Sking100 we too were naive in not getting various items in writing.   Sking100 said he was flabbergasted with himself.  We will go a bit further than that with ourselves!!

What sold the development to us was the views and the conservation area to protect the views.  We were also told that the maximum build height was 12 metres as decreed by the Council.  We feel that the habitation licence issued by the same Council was the same as a rubber cheque. 

When we saw the level of development in the area one year after we signed on the dotted line (June 2004) we put our apartment up for sale.  We never had one enquiry.  Due to our naivity, we started looking around the Costa del Sol and we came across various people who had bought apartments on other developments for views only to lose them with developments built in front.  One man bought 4 apartments on the edge of a rock face which went down to a road.  He was assured that no development would ever take place because of the rock face, road etc.  2 years on the new development in front of his apartments is almost finished!  This was going to be his home and rental income to support him.  It isn't now!!

Sking100 has asked if anyone has anything in writing about the connecting road, all moving in on time etc etc.  We would add to this does anyone have anything in writing about the conservation area?

We would be interested in anyone's views...  We are in block 19.

I was never given assurances that the land wouldn't be built on, but thought to myself that it would take some doing to spoil the view if a development did. I WAS told that views would NOT be spoilt on the development itself (Gibralter / Africa), but alas in block 13, the views are almost gone from my apartment (unless I stand tip toed, with one eye shut, looking between the apartments in front of me!) to the south west, but south east are fantastic. So unless the built some high rise blocks, fingers crossed, I'm ok i hope(?).

 I think it all boils down to what you we told + what has been delivered + we have all been stupidly naive in believing people rather than seek it in writing. I normally don't associate myself with being stupid, but in this case the £ signs clearly indicate I was!

I serioulsy think we need to get together as a group + pursue rather than accept what's happening done't you all? I'm UK based + don't know how feasible this is. Anyone else?

 

By the way, I take it you still own the apartment even though you put it up for sale 2years ago, right? Stinks of being sold down the river like many of us! However, if we could sought roads in particular, this is undoubatbly a quality establishment (+ we are paying for the privilage), which will flourish medium to long term like most investments do. It certainly has the potential to do well, but to rent it out we need good access roads!

We were also told that on completion, as everyone would be completing at the same time, we would be able to form a committee, ie one representative from every block to manage the development.  We have yet to hear of any proposed meeting and cannot see how this will happen as everyone has completed, and still are completing, at different times.  Like everyone else, we hope, we have paid 1200 euros to the Management Company.  We have no idea who this is but we believe it to be Dream Hills at the present time.  We don't know when the 1200 euros will start to be used or when we will have to pay again.  We did ask these questions in the Notary's office and was told this has still to be advised.  Does anyone have any more information on this?

So, yes, we do still own the apartment, albiet a lot greyer than when we first saw the site!

Please confirm, €1200 for community fees? Is that per quarter? If so that is very high!
