Hello everyone,

I address you as the representative of Grupo Gpsur, the development company for Marbella Hill View, in my capacity as sales coordinator.

     I have been following up this forum during the last few weeks and, to be honest, my point of view is that the information you have been receiving with regards to Marbella Hill View has many inaccuracies. This may have been, in part, the responsibility of Grupo Gpsur, as we considered that VIVA Estate was the appropriate way to keep you informed.

     Due to this misunderstandings, we find it convenient to invite you to visit us in Malaga, where I will attend you personally, I will show you the building works and I will be glad to answer any questions you may have.

     I consider this company has always acted in good faith and I confirm our willingness to welcome you in our office.

     In any case, I think it is important to explain, on the whole, the unpredictable events of which this company has not been responsible and which have delayed the completion of the building works in Marbella Hill View.

 

Firstly, with the aim of informing you about the problems related to Marbella Council, I would like to remind you that the promotion “Residencial Marbella Hill View” is located at the OJEN municipal area. For that reason, all the problems which have risen during the last months, DO NOT AFFECT OJEN’S COUNCIL. In this regard, “Residencial Marbella Hill View” complies with all the legal requisites. Thus, all the documentation needed was shown to your lawyer before the signature of the private sales agreement. 

As you know, the original deadline for finishing the contract was, initially, May- June, 2006. In order to satisfy your request for information regarding the real delay, we would like to clarify the actual reasons and the deadline established for completion of construction as estimated to date, as follows:

 

-         The construction company contracted for carrying out the building works did not pay to the suppliers (a company which does not belong to the companies group which form GRUPO GPSUR). The construction contract we had signed with this company was terminated by the end of the year 2005. Immediately after, another construction company was contracted, named CONSTRUCCIONES URBANAS CASSE S.L., which needed a minimum period of time to reorganize the construction and to make it function to the best of its capacity. Up to date, the construction has a steady pace and they are meeting all the aims and deadlines which they have been fixed.

For this reason, a three month delay was caused, of which you were given notice through your lawyer. Thus, the deadline for completion of construction was extended to October, 2006, that is to say, three months later than what was established in the contract.

 

-         During December, 2005 and January, 2006, there was a SAND AND GRAVEL QUARRY STRIKE, which lasted, legally, 47 days. However, due to the shortage of supplies produced during that period, more than two months were needed to recuperate the construction’s normal pace (order waiting list and workers who went outside the province to look for a job, as the strike was indefinite). For this reason, the deadline was, again, extended. Thus, we have set December, 2006 as the new deadline for completion of construction. In relation to the contract, this aspect is considered to be a matter beyond our control. Therefore, GRUPO GPSUR is not reliable for the 4 months delay.

 

By this means, we have tried to justify the deadline extension to December, 2006. In any case, the delay has not been the result of  this company’s bad management. On the contrary, a series of unfortunate circumstances have not permitted us to meet our first deadline for completion of construction, to which we committed ourselves from the beginning.

GRUPO GPSUR has always acted in good faith and has always been willing to solve the problems as well and as soon as possible. That is why we have made available for you a visit to the building works in order to show you that, regardless of the circumstances, the construction is going on without any problems.

 

Having no further concern, we hope that this letter clarified the actual situation, and we wish that you keep on placing your trust in our company.

This is an encouraging letter from GPS, in so far as the usual expectation is for Spanish developers 'to spit in your face and claim it is raining'.  As regards "inaccuracies", I would challenge the company to explain away my observations (from the El Vicario site opposite) over some significant period of time of the work practices on the site.  I contributed a lengthy account and supplied plenty of photos (to those who asked me) to substantiate my claims of attrocious amateurism in relation to built quality, management of the site and microscopic efficiency - when measured in terms of the ratiop of useful outcome to human and machine movements on the site.  I have been around for 60 years and have never seen such attrocious standards.  This is not dealt with in the GPS response, and I think it cannot be dismissed easily.
