Dear all

On Wednesday I collected my post and found a bill from the Suma office, which is for the above. This tax is the Spanish equivalent of the rates and is collected by local government.

After speaking to a couple of neighbours it seemed that they didn't have a bill for 2007/8. I then emailed my solicitor who has advised me that I have to pay the 2008 bill (which they have) and that it was advisable to pay the 2007 bill(which I have) too.
I was confused what to do, as most people have not got any bills and I wasn't sure if the solicitor was correct.

Through the research I have done on the internet for the past couple of days and by reading some forums I found that, the local tax bill is payable by everyone (bar some individuals) Explained later.
I then emailed my solicitor to get some proper answers, they have said:

'By law in Spain you have to pay for the local rates from the 1st Janaury that you owned the property, which in your case was 2007. The builder had handed the area to the local authority who had accepted it and hence the bill was issued. We cannot force you to pay it, we can only advise that non payment will eventually force Suma to place an embargo on your property. The bill for 2007 was due to be paid earlier in the year. The first local rates bill can be issued up to 5 years after completion and is backdated, which is why you have received the bill in 2008'.
A man in Estepona received a Suma bill from their solicitor for €2424.86 in one go, as it was backdated for the 4 years since he completed!

I then made a trip to the Suma office today and I saw a brief list of those who have been issued with a bill for 2007. I can't remember the names, but it looked like most of phase 2. If you are here then make a trip there to collect your bills. 
The lady at desk 9 who speaks english, confirmed that it doesn't matter if there were no local services, eg street cleaning, bins etc. The moment the builder hands over to the local authority, we are liable for the local taxes.

I think this will only affect phase 2, as it was during 2006 when most of us completed. Therefore we are liable to pay for the backdated Suma bill of 2007. Unfortunately, as we completed Dec 2006, we have to pay as of Jan 2007.

Phase 1 have probably already been paying the tax and as for phase 3, completion was much later in 2007, so phase 3 do not need to pay for 2007.

Please remember it doesn't matter if you live here, are a holiday maker or rent your property out, this tax is still payable. Also, it is advisable to check your pigeon holes for the 2008 bill, as this needs to be paid soon. If you don't live here then find out from your solicitor/fiscal rep. who will advise you. It maybe that you have a direct debit set up and your solicitor has already arranged for the taxes to be paid.

The deadline for 2008 bill is 03/10/08, for residents who live here, you will have already seen the blue posters around our area.

Geoff1 - I am not sure why nobody replied to your thread, which was dated 30 July 2007 'IBI real estate tax'. 

I think it is an important issue and most of us are totally oblivious to the laws and requirements here. At the end of the day, if you are resident or a holiday maker, we are all foreigners here, we can only help each other by sharing our experiences and supporting each other. I wouldn't wish for anyone to be facing penalties or an embargo on their property, so that's why I wanted to share my experience with you.

I will also be creating another thread shortly for another tax that needs paying (sorry!).

I wrote to aroca and this is what they sent me back only yesterday regarding IBI, 

Local rates ( IBI ) can take up to 5 years to be issued on a new property and then they are backdated. The local rates for your property have not yet been issued.




they did take Fiscal fees and wealth tax back in may though

We paid fiscal fees in april and wealth tax in june and local rates 08 last week

Looks like we all are paying it now....... at least there shouldn't be any nasty surprises in a couple of years time hopefully. Will have to wait and see what will replace the wealth tax next

Our sumo tax (local tax) was taken from our bank the beginning of August 86 euro, 

What is the weather like there, in France at the moment,  weather not very good, 9 degrees this morning! Coming out to Spain the beginning of October, hope it will still be warm,

Yeah as I mentioned we would all be liable for paying for 2008. I just wanted to advise that some people may get one for 2007 too. 

I guess you guys were lucky as you are one phase 3.

We didn't get an actual bill, the money was just deducted by Aroca.
Now paid 3 lump sums, their service charges, the wealth tax and now 90 something euros which we presume is the IBI

We paid the same, it seems a bit strange not to recieve a bill though, even just to keep it for records in case of proof at a later stage if required, Hope you are all well just back and the weather was glorious.

Only some people got a physical bill in the pigeon holes. As mentioned earlier, I received the ibi 2007 in the pigeon holes and I went to get the 2008 one from the Suma Office in Orihuela. Aroca do not hold the bills, that's what they said to me.

It is correct you were charged for fiscal fees from Aroca and the IBI which was around 90E and the wealth and income tax.
