Making a spanish will and inheritance tax

Hi I'm Maureen and would like to ask anyone if they are in my position.  I have re-married and my husband has no children.  I have 2 from a previous marriage and wondered whether I can make my own will and leave my half share to my children or whether it has to all go to my husband.  The deeds are in joint names!!!

Hi Maureen

This is something that we are currently looking at, so I will post something when I have checked it out. My understanding is that Spanish Inheritance Tax actually favours children not spouses, however if you don´t have a Spanish will it could get complicated. John and I have been married before and have 3 children each, so we both want to leave our half to our children, however we don´t want the surviving partner to be forced to sell either!
